RESOLUTION NO. 2024-464
RESOLUTION APPROVING A TEMPORARY
CONSTRUCTION EASEMENT AGREEMENT WITH
SUNNYSIDE TERRACE, INC., LOCATED SOUTHEAST OF
1900 WESTCHESTER ROAD, IN CONJUNCTION WITH THE
SUNNYSIDE CREEK DRAINAGE IMPROVEMENTS
PROJECT, AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE SAID DOCUMENT.
WHEREAS, the Temporary Easement Agreement with Sunnyside Terrace, Inc., located
southeast of 1900 Westchester Road, in conjunction with the Sunnyside Creek Drainage
Improvements Project, of the hereinafter described parcel, is to allow for construction to clear
and regrade Sunnyside Creek, allowing for a better flow of water, and
WHEREAS, Sunnyside Terrance, Inc., is donating the Temporary Easement to the City
of Waterloo.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WATERLOO, IOWA, that the Temporary Easement Agreement between Sunnyside Terrace,
Inc. and the City of Waterloo, Iowa for the hereinafter described parcel, is accepted and
approved, and the Mayor and City Clerk are authorized and directed to execute said document on
behalf of the City of Waterloo, Iowa.
DESCRIPTION TEMPORARY EASEMENT
A PARCEL OF LAND SITUATED IN PART OF LOT 110 OF WATERLOO
COUNTRY CLUB ADDITION, CITY OF WATERLOO, COUNTY OF BLACK
HAWK, STATE OF IOWA, MORE PARTICULARLY DESCRIBED AS
FOLLOWS.
BEGINNING AT THE SOUTHEASTERLY CORNER OF SAID LOT 110;
THENCE SOUTH 50°50'42" WEST (ASSUMED BEARING FOR THE
PURPOSE OF THIS DESCRIPTION) ALONG THE SOUTHERLY LINE OF
SAID LOT 110, A DISTANCE OF 17.71 FEET; THENCE NORTH 09°57'57"
WEST, 34.34 FEET; THENCE NORTH 26°48'20" EAST, 20.82 FEET TO THE
NORTHEASTERLY LINE OF SAID LOT 110; THENCE SOUTH 14°00'44"
EAST ALONG THE NORTHEASTERLY LINE OF SAID LOT 110, A
DISTANCE OF 42.49 FEET TO THE POINT OF BEGINNING.
TOTAL AREA OF THE TEMPORARY EASEMENT IS 555 SQUARE FEET OF
WHICH 139 SQUARE FEET IS EXISTING 8-FOOT DRAINAGE AND
UTILITY EASEMENT.
AREA OF NEW TEMPORARY EASEMENT IS 416 SQUARE FEET.
