W.Donald Street Bike Trail Project
PERMANENT EASEMENT AGREEMENT
The undersigned does hereby grant and convey unto the City of Waterloo, Iowa, a
permanent easement across the following described property in the City of Waterloo,
Black Hawk County,State of Iowa:
See attached easement exhibit
for the purpose of the construction of the West Donald Street Recreational Trail Project,
together with a right of ingress and egress thereon.
SAID PERMANENT EASEMENT WILL STILL REMAIN IN THE OWNERSHIP OF
THE SYLVA M. FEUERHELM AFTER CONSTRUCTION OF THE PROJECT IS
COMPLETED, AND THE CITY OF WATERLOO IS RESPONSIBLE FOR
MAINTENANCE AND SNOW REMOVAL FOR THE RECREATIONAL TRAIL IN
QUESTION.

As owners of real estate needed for the above-referenced project and parcel_
and acknowledging the fact that(I) (We) are entitled to just compensation of
the subject property, nevertheless, desire to donate property for the use of a
permanent easement to the City of Waterloo for the West Donald Street
Recreational Trail. (I) (We) waive such compensation rights and will
execute the necessary documents for the City of Waterloo, Iowa.
This donation to the City of Waterloo, Iowa, is made without any coercive
action of any nature.
