i\ar.d ; The City of Waterloo has been contacted by the Iowa DOT District 2 Office regarding
the above referenced flood damage repair project. The City of Waterloo understands that
QUENTIN I there is a need for this project. The project will have a temporary affect on a Section 4(f)
HART Property,the recreational trail passing under the US 218 bridge that is under the
Ward 4
jurisdiction of the City of Waterloo.

hvELPER The City of Waterloo has been notified that as part of the project, the contractor and DOT
1v"r`I inspection staff will need to cross the City's recreational trail at a point west of the bridge
BOB to gain access to the project site. Intended work will be to repair undermined concrete on
GREENWOODa wing dike, fill scour holes and place approximately 1000 tons of rip-rap to armor the
At-L'rr`'`' river bank. Any damage to the trail caused by the contactor's work will be restored to
STEVE pre-project conditions, as part of the project.

At-Lar:te Further,the contractor and Iowa DOT staff will need to access the project site via George
Wyth State Park and the former West Donald Street roadway thru property owned by the
City of Waterloo. By this letter,permission is granted to the DOT for the use of this
roadway for project activities.
It is understood that the project will meet the following criteria:
1. Duration(of the occupancy) is to be temporary, i.e., less than the time needed for
construction of the project, and there will be no change in ownership of the land;
2. Scope of the work is minor, i.e., both the nature and the magnitude of the changes
to the 4(f)resource are minimal;

3. There are no anticipated permanent adverse physical impacts, nor will there be
interference with the activities or purpose of the resource, on either a temporary or
permanent basis, including but not limited to the rights of other authorized users
for shared access to private West Donald Street;
4. The land being used will be fully restored, i.e., the resource must be returned to a
condition which is at least as good as that which existed prior to the project. This
includes the vehicular pathway known as private West Donald Street.
S. The gate separating the entrance to private West Donald Street from George Wyth
State Park will be kept closed at all times, except to allow for passage of project
traffic.
This letter documents the agreement of the appropriate city officials having jurisdiction
over the resource regarding the above conditions.
