2.0 PROJECT STANDARDS (limit to 2 pages)
2.1 Priority shall be given to entities which demonstrate the greatest need for a handheld X-
Ray fluorescence (XRF) analyzer as determined by percentage of housing units to be
subject rehabilitation activities over $25,000 in hard costs to total number of housing units
at all dollar levels to be rehabilitated. (30 points)
The City of Waterloo, Community Development Department, is overseeing the Jumpstart Federal and
Jumpstart State funds provided for the Disasters of 2008. We are completing rehabilitation of homes that
were affected by floods and need our assistance to feel they are back to pre-flood conditions. We estimate
that 35 percent of our applications will need total rehabilitation expending over $24,999, the federal limit
before lead abatement is required. From 2002 to 2006, 7.35 percent of children tested for lead poisoning
had elevated levels as defined by the Center for Disease Control. Of the children in the 50703 zip code
area, the area hardest hit by the floods of 2008, 10.73 percent had elevated blood lead levels. Waterloo
has a high percentage of aging homes. Of all Waterloo homes, 89 percent were built before 1978; the
year lead based paint was banned. After review of our applications for Jumpstart funding, about 90
percent of the applicants meet the income guidelines for federal funds.
2.2 Priority shall be given to grantees with regional plans and agreements to share X-Ray
fluorescence (XRF) analyzer. Proof of plan to share the analyzer must be attached and
signed by partnering groups. (30 points)
The City of Waterloo will share the XRF Analyzer(Unit) with other properly trained and certified lead
professionals representing local governments and non-profits, CAP agencies and others involved in
disaster recovery work. The Unit will be used to determine the lead based paint content in abatement
activities of homes undergoing rehabilitation due to the 2008 disasters. The City of Waterloo will be
responsible for all aspects of ownership, including insurance, liability, training and maintenance of the
units. Signed Agreements are attached with the City of Cedar Falls, Black Hawk County Health
Department, and Iowa Northland Regional Council of Governments (INRCOG).
2.3 The Iowa Department of Public Health approves training providers and then certifies
individuals who meet the requirements in the regulations. Grantees shall have written
policy and procedures to utilize and lend the units to properly trained and certified local
non-profits, CAP agencies, and others to use the units to determine the lead based paint
content of the structures and homes they plan to rehabilitate. (20 points)

disaster recovery work. The Unit will be used to determine the lead based paint content in abatement

To borrow the Unit the following conditions must be met:

• Proof of certification to operate the XRF
• Proof that the operator is a certified Lead Inspector/Risk Assessor with the Iowa Department of
Public Health
• Information form for agency borrowing the XRF is signed by the agency director, including
complete name of the agency, executive director, phone number, dates the Unit will be borrowed
and returned, and that the Unit will only be used within the State of Iowa
Procedures for use will be kept with the Unit. The City of Waterloo Community Development staff has
two certified operators that will review the procedures with the borrowing agency before the Unit is
checked out to assure the borrower is comfortable with the operation. When the Unit is returned, one of
the certified operators will inspect the Unit and assure that it is properly stored away. Maintenance on the
Unit will be done as recommended by the manufacturer.
We anticipate sharing this Unit with the City of Cedar Falls, the Black Hawk County Health Department,
Iowa Northland Regional Council of Governments (INRCOG), and any other Iowa agency that will agree
to sign our sharing form. We understand that INRCOG is applying for their own Unit. Since INRCOG
covers a six county area, and they will be sharing with Waverly and UEP, a five county area, we would
share our XRF when INRCOG's is checked out to another entity. During this disaster recovery time, we
feel two XRF's for eleven counties and two Entitlement Cities would best serve our clients in a timely
manner.
2.5 Policies and procedures regarding proper handling, maintenance, storage and operation of
X-Ray fluorescence (XRF) analyzer. (10 points):
The City of Waterloo, Community Development Department will follow all of the manufacturers' policies
and procedures regarding handling, maintenance, storage and operation of the XRF analyzer. We also
understand the Unit must be licensed by the Iowa Department of Public Health. Radioactive material is
considered a hazardous material for the purposes of transportation of a portable XRF analyzer and
therefore subject to the Department of Transportation materials law. The City of Waterloo has two staff
members that are certified to use an XRF. We are also aware of the necessary storage requirements for
this Unit and are prepared to designate a locked storage area with proper signage. Maintenance will be
completed on the Unit based on the manufacturers' recommendation. Funds from the Healthy Homes and
Lead Hazard Control Grant or our annual allocation of CDBG funds will be used for maintenance. Only
certified operators will be allowed to use the analyzer, and proof of certification will be kept with the
"check-out" log.
2.6 Proof of insurance (10 points):
A letter is attached documenting that the XRF analyzer will be insured through the City of Waterloo's
insurance program.

3.2.1 Abide by the requirements of Titles VI and VII of the Civil Rights Act of 1964, as
amended, and the Rehabilitation Act of 1973, as amended, which bar discrimination against any
employee, applicant for employment, or any person participating in any sponsored program, on
the basis of race, creed, color, national origin, religion, sex, age, or physical or mental disability;
3.2.2 Abide by the requirements of the Americans with Disabilities Act;
3.2.3 Require compensation for employment at not less than minimum wage;
3.2.4 Provide safe and sanitary working conditions;
3.2.5 Expend federal funds received as a result of this application on X-Ray fluorescence
(XRF) analyzer and adhere to all federal requirements. Analyzers shall be generally licensed
and must be approved by HUD and EPA for use in the detection of lead-based paint;
3.2.6 Insure that only properly trained and certified local non-profits, CAP agencies, and others
to use the units to determine the lead based paint content of the structures and homes they plan
to rehabilitate.

regulations;

Agreement to Share X-Ray Fluorescence (XRF) Analyzer
The City of Waterloo agrees to share the XRF analyzer with the City of
Cedar Falls as needed. The City of Cedar Falls agrees that only a
certified operator will perform any lead testing using the City of
Waterloo's XRF Analyzer. The City of Waterloo maintains ownership
and maintenance of the analyzer.

INRCOG PARTNERING AGREEMENT FOR USE OF X - RAY
FLUORESCENCE ANALYZER (XRF)
The Iowa Northland Regional Council of Governments
( INRCOG) and the City of Waterloo are both applying
to the Iowa Department of Economic Development
( IDED) for funds to purchase an XRF Analyzer .
Because INRCOG' s machine will be used throughout an
eleven ( 11 ) County region the City of Waterloo and
INRCOG have agreed that they will share both
machines as needed . Both entities agree that only a
certified operator will perform any lead testing
using an XRF Analyzer and that each entity shall be
responsible for ownership and maintenance of their
respective machines .
