AGREEMENT
Now, on this oZ S day of m , 2009, this Agreement is hereby
made between the City of Waterloo (hereinafter referred to as "City"), and Joel C. Cizek and his
wife, Connie J. Cizek (hereinafter referred to as "Cizeks.")
This Agreement involves the property located in Waterloo, Iowa, known as 1807 Black
Hawk Street. The parties agree that this property is dilapidated, vacant, and abandoned pursuant
to Iowa Code Section 657A.10A. Cizeks have recently come into possession of this property by
purchasing it from Mooring Tax Asset Group XIX, LLC. This property was about to be the
subject matter of a 657A action to be filed by the City, but the Cizeks stepped in and took the
place of Mooring by purchasing the property. As a result of this purchase, the parties hereby
agree as follows:
1. That the Cizeks shall demolish this property. In doing so, they will follow
demolition rules set forth by the City in terms of removal of the rubbish created by the
demolition, filling in of the foundation, obtaining appropriate permits from the City, and all other
applicable rules and ordinances.
2. This demolition shall be completed by July 1, 2009.
3. If the demolition is not completed by that date, the City is free to step in and
complete the project and assess the costs of completion to the property.
