HomeMy WebLinkAboutCity of Cedar Falls, BHC-Memorandum of Understanding-05.26.2009 . moo — 413 MEMORANDUM OF UNDERSTANDING Between City of Waterloo, City of Cedar Falls, and Black Hawk County, Iowa 441 This Agreement is made and entered into this 24 day of May , 2009, by and between City of Waterloo, Iowa; City of Cedar Falls, Iowa: and Black Hawk County, Iowa. WHEREAS, funds have been allocated by the 2009 Justice Assistance Grant (JAG) for the cities of Waterloo, Cedar Falls, and the county of Black Hawk in the amount of four hundred forty one thousand, five hundred eighty nine dollars ($441,589.00). It is mutually agreed that Waterloo Police Chief Thomas Jennings, Cedar Falls Police Chief Jeff Olson, Black Hawk County Sheriff Tony Thompson and Black Hawk County Attorney Thomas Ferguson have been designated as representatives for their respective governing bodies. WHEREAS, all parties agree that the JAG Grant will be used for personnel costs for the investigation and prosecution efforts of the Tri-County Drug Enforcement Task Force. WHEREAS, The City of Waterloo, City of Cedar Falls, and Black Hawk County believe it to be in their best interests to reallocate the JAG funds. NOW THEREFORE, the CITY OF WATERLOO, CITY OF CEDAR FALLS and BLACK HAWK COUNTY agree as follows: Section 1. THE CITY OF WATERLOO agrees to pay CITY OF WATERLOO a total of$334,105.00 of JAG funds. THE CITY OF WATERLOO agrees to pay CITY OF CEDAR FALLS a total of $75,734.00 of JAG FUNDS. THE CITY OF WATERLOO agrees to pay BLACK HAWK COUNTY SHERIFF'S OFFICE a total of$15,875.00 of JAG funds. THE CITY OF WATERLOO agrees to pay BLACK HAWK COUNTY ATTORNEY'S OFFICE a total of$15,875.00 of JAG funds. Section 2. THE CITY OF WATERLOO agrees to use $66,821.00 for Byrne funding. THE CITY OF CEDAR FALLS agrees to use $15,147.00 for Byrne funding. THE BLACK HAWK COUNTY SHERIFF'S OFFICE agrees to use $3,175.00 for Byrne funding. THE BLACK HAWK COUNTY ATTORNEY'S OFFICE agrees to use $3,175.00 for Byrne funding. 1. All parties hereto agree that the Waterloo Police Department shall be the administrator for this Grant and that said Department will follow generally accepted accounting principles to appropriately record revenue and expenses for this grant. 2. All parties to this Agreement agree that they will follow the regulations for the receipt and administration of these funds promulgated by the Justice Assistance Grant administrators. 3. Nothing in the performance of this Agreement shall impose any liability for claims against Black Hawk County other than claims for which liability may be imposed by the Iowa State Tort Claims Act. 4. Nothing in the performance of this Agreement shall impose any liability for claims against the City of Waterloo or the City of Cedar Falls other than claims for which liability may be imposed by the Municipal Tort Claims Act. 5. Each party to this Agreement shall be responsible for its own actions in providing services under this Agreement and shall not be liable for any civil liability that may arise from the furnishing of the services by any other party. 6. The parties to this Agreement do not intend for any third party to obtain a right by virtue of this Agreement. 7. By entering into this Agreement, the parties do not intend to create any obligations, express or implied, other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto.
