Mayor Pro Tem Harold Getty in the Chair. Roll Call: Anders, Jordan, Krizek, Murphy, Gronen, Getty, Berry. Invocation by: Reverend Merrill Siler, St. Paul's United Methodist Church. ORAL PRESENTATIONS 113539 - Martin Culpepper stated that he left some information with the council a month ago, and he has not heard from anyone and he wanted to know the status of his request. Mr. Culpepper stated he also dropped some information off at the Mayor's office a few weeks ago, and he has not heard from him. Councilperson Anders stated that he believed the information was in the Mayor's office, and that someone will get back to Mr. Culpepper. Motion carried. 113541 - Murphy/Jordan that the Minutes, as proposed, for the Regular Session on Monday, March 27, 2000, at 5:30 p.m., be accepted and approved. Ayes: Seven. Motion carried. Councilperson Jerry Anders read a proclamation declaring April 9 - 15, 2000, as Crime Victims' Rights Week. Councilperson Deb Berry read a proclamation declaring April 2000 as Fair Housing Month. HEARING AND BIDS 113542 - Krizek/Jordan that proof of publication of notice of public hearing on the proposed Anaerobic Digesters Project for Waterloo Pollution Control Facility, Contract No. 550, as published in the Waterloo Courier on March 13, 2000, be received and placed on file. Ayes: Seven. Motion carried. 113543 - This being the time and place of public hearing, the Mayor Pro Tem called for written and oral objections and there were none. Jordan/Murphy that the hearing be closed and oral and written comments be received and placed on file. Ayes: Seven. Motion carried. 113544 - Anders/Berry that "Resolution confirming approval of plans, specifications, form of contract, etc. in conjunction with Anaerobic Digesters Project for Water Pollution Control Facility, Contract No. 550", be adopted. Motion carried. 113554 - Gronen/Berry that "an Ordinance vacating a portion of alley abutting property generally located on Court Avenue", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 113555 - Jordan/Krizek that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 113556 - Anders/Murphy that "an Ordinance vacating a portion of alley generally located on Court Avenue", be considered and passed for the second and third times and adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor Pro Tem assigned No. 4409. 113557 - Jordan/Murphy that "Resolution authorizing said sale and conveyance", be adopted and City Attorney instructed to prepare and deliver deed accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 2000-159. 113558 - Jordan/Anders that proof of publication of notice of public hearing on request of Short's Travel to rezone from "R-4" Residence District to "R -4,C -Z" Conditional Zoning District property generally located at the southeast corner of Ansborough and Ridgeway Avenues as published in the Waterloo Courier on March 20, 2000, be received and placed on file. Ayes: Seven. Motion carried. 113559 - This being the time and place of public hearing, the Mayor Pro Tem called for written and oral objections and there were none. Ayes: Seven. Ordinance adopted and upon approval by Mayor Pro Tem assigned No. 4410. UNFINISHED BUSINESS 113563 - Anders/Jordan that communication from Leisure Services Director transmitting recommendation of award of contract for Option C in the amount of $29.97 per acre per mowing to Professional Lawn Care of Waterloo, Iowa, and Option B in the amount of $27.50 per acre per mowing to B & B Exchange of Waterloo, Iowa, in conjunction with the 2000 Right of Way Mowing Contract, be received, placed on file and "Resolution approving said award of contract", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 2000-160. PETITIONS FROM PUBLIC 113564 - Gronen/Murphy that communication from City Clerk transmitting request of the March of Dimes Birth Defect Foundation to hold annual March of Dimes WalkAmerica on May 6, 2000, starting at 9:00 a.m. and ending around 11:30 a.m., with route to begin and end at Central Middle School, be received, placed on file and "Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 2000-161. 113565 - Gronen/Murphy that communication from Police Chief transmitting request of Cedar Valley Medical Specialists to hold a 5K -10K Run/Walk for Head and Neck Cancer Awareness on April 22, 2000, from 8:00 a.m. to 11:00 a.m., with route to begin and end at Central Middle School, be received, placed on file, and "Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 2000-162. DOCUMENTS 113566 - Berry/Gronen that communication from the Village Initiative transmitting M.A.P.L.E.S. Neighborhood Association commitment form for Neighborhoods of Promise, be received, placed on file and "Resolution approving said document" be adopted and Mayor Pro Tem authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 2000-163. 113567 - Anders/Jordan that communication from Police Chief transmitting Governor's Alliance on Substance Abuse Grant application in the amount of $407,037.00, with a 25 percent cash match of $48,185.00, in conjunction with funding the Tri -County Drug Enforcement Task Force, be received, placed on file and "Resolution approving said grant application", be adopted and Mayor Pro Tem authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 2000-164. • • April 3, 2000 • ORDINANCES TO BE ADOPTED 113568 - Jordan/Gronen Page 5 that "an Ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by repealing Section 2-16, Meetings: Dates, Time and Place for Regular Meetings; Adjourned Meetings; Calling Special Meetings; Limitation on Business, of Division 1, Generally, of Article II, the Council, of Chapter 2, Administration; and by enacting in lieu thereof a new Section 2-16, Meetings: Dates, Time and Place for Regular Meetings; Adjourned Meetings; Calling Special Meetings; Limitation on Business, of Division 1, Generally, of Article II, the Council, of Chapter 2, Administration (permanently change the time of council meetings from 7:00 p.m. to 5:30 p.m.), be received, placed on file, considered and passed for the first time. Prior to a vote on the above motion, the following comments were heard. Councilperson Murphy commented that the 5:30 p.m. meetings are working so well have we thought about moving the council meetings to 4:30 p.m. Councilperson Getty stated that the 4:30 p.m. time has been mentioned, but we should move ahead with this change before we talk about other starting times. Councilperson Getty stated that on Thursday he asked the council to talk to their constituents regarding the 5:30 p.m. meeting time. Councilperson Getty stated that he has had some feedback, some good. Councilperson Getty noted that the council meetings are rebroadcast in their entirety on the Government Access Channel eight times during the week. Following comments a vote was taken on the above motion with the following result. Ayes: Seven. Motion carried. BILLS PAYMENT 113569 - Krizek that "Resolution approving Schedule AP640, pp. 1-62, dated April 3, 2000, in the amount of $1,089,225.65, a copy of which is on file in the City Clerk's Office", be adopted, together with recommendation of approval of the Finance Committee. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 2000-165. NEW BUSINESS 113570 - Krizek/Jordan that communication from Waterloo Water Works General Manager transmitting request of Joe L. and Debra S. Henderson to certify $545.00 for work performed by Waterloo Water Works at 408 Saxon Street, together with recommendation of approval of Board of Waterloo Water Works Trustees, be received, placed on file and "Resolution approving said request", be adopted and City Clerk instructed to notify Black Hawk County Treasurer of same. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 2000-166. 113571 - Jordan/Berry to instruct City Engineer to prepare plans, specifications, form of contract, etc. in conjunction with F.Y. 2000 Sycamore Street Reconstruction and Vinton Street Storm Sewer Improvements, Contract No. 613, be received, placed on file and approved. Ayes: Seven. April 3, 2000 Page 6 NEW BUSINESS CONTINUED 113574 - Murphy/Jordan that "Resolution setting date of hearing on plans, specifications, form of contract, etc. as April 24, 2000, at 5:30 p.m. in the City Hall Council Chambers and taking of bids on the above described project", be adopted and City Clerk instructed to publish notice of same. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 2000-168. TRAVEL REQUESTS 113575 - Krizek/Jordan that the following travel requests, with expenses not to exceed amount shown, be received, placed on file and approved: 1. Deborah Collett, Housing/Block Grant Assistant Program Manager, and Gladys N. Rainey, Housing Coordinator, to attend Iowa NAHRO Progress for the Millennium Seminar in Fort Dodge, Iowa, on April 12 - 14, 2000, with costs not to exceed $676.00, including use of city vehicle. 2. John Kehoe, Chief Electrical Inspector, to attend 62°d Annual Iowa Chapter Meeting of the IAEI in Ames, Iowa, on April 5 - 7, 2000, with costs not to exceed $255.00. Ayes: Seven. Motion carried.
