HomeMy WebLinkAboutWaterloo Police Protective Association-Memorandum of Understanding-12.04.2006 /D.So MEMORANDUM OF UNDERSTANDING City of Waterloo,Iowa And Waterloo Police Protective Association Effective January 1, 2007, Section 10.01 - Scheduled Leave Accrual, of the Collective Bargaining Agreement between the City of Waterloo and the Waterloo Police Protective Association (parties) executed June 7, 2006, shall be amended to include the following understanding of the parties, without changing any of the language in Section 10.01. The intent of this Memorandum of Understanding is to express the parties' understanding of the sentence in Section 10.01 that reads, "All part-year adjustments shall be handled in the same manner" for employees hired after January 1, 1994. After the initial year of employment, with respect to any calendar year in which an employee becomes eligible for a greater number of scheduled leave hours due to completion of a specified number of years of service, on January 1 of such year such an employee shall receive a pro-rated amount of scheduled leave for the year, with pro-ration done on a monthly basis in relation to the month in which the employee's anniversary date falls. The pro-rated amount of scheduled leave shall be calculated by adding (a) the result of multiplying the appropriate number of hours as set forth in Section 10.01 by the number of full months up to and including the employee's anniversary date of employment, and then dividing by twelve (12) and (b) the result of multiplying the appropriate number of hours as set forth in Section 10.01 by the number of full months remaining in the calendar year after the employee's anniversary date, and then dividing by twelve(12). By way of illustration, for an employee who on May 15 of a given year completes six (6) years of service, his scheduled leave hours for that year shall be calculated as follows: (a) 160 hours times 5 months equals 800,divided by 12 equals 66.7 hours, Plus (b) 208 hours times 7 months equals 1456, divided by 12 equals 121.3 hours for a total eligibility of 188 hours(66.7 plus 121.3 = 188). The employee is eligible for an additional 28 hours of vacation during this calendar year(188-160=28 hours). For any calendar year in which the above pro-rated calculation of scheduled leave hours is done, the employee may not,before his or her anniversary date,use more scheduled leave hours than they would be entitled to use in the preceding year. Referring to the above illustration, the employee may not use the additional 28 hours of vacation until after May 15 of that year. The parties acknowledge that there may be, or in the past may have been, some instances through December 31, 2006 in which changes in scheduled leave eligibility have not been handled in the manner set forth herein. WPPA agrees for itself and its members that no grievances will be filed nor claims asserted against the City of Waterloo in respect of hours for which employees would have been,but were not, credited with additional hours as set forth above.
