PARTIAL RELEASE OF REAL ESTATE MORTGAGE
The City of Waterloo, the present owner of the mortgage for the benefit of the
Waterloo Water Works hereinafter described, for valuable consideration, the receipt of which
is hereby acknowledged, does hereby confirm that the following described real estate
situated in Black Hawk County, Iowa, to-wit:
Part of the Northeast Quarter of Section No. 34 lying on the West side of
the following described survey centerline, designated by station points
100 feet apart, numbered consecutively from South to North, of Primary
Road No. 21, as established in 543 LD 301: Beginning at Sta. 2242+89.6,
a point 118.6 ft. Easterly of the S% Corner of said Sec. 34, on the South
line thereof; thence Northerly 5,301.3 ft. to Sta. 2295+90.9, a point 117.8
ft. Easterly of the N% Corner of said Sec. 34, on the North line thereof;
said part of the Northeast Quarter being more particularly described as:
All that part thereof that lies West of a line described as beginning at a
point 38 ft. normally distant Westerly from Sta. 2269+33, on the South line
of the North 1/2 of said Sec. 34; thence Northerly, parallel to said
centerline, to a point 38 ft. normally distant Westerly from Sta. 2295+90.9,
on the North line of said Sec. 34, all in Township No. 88 North, Range No.
13 West of the Fifth Principal Meridian, Black Hawk County, Iowa.
is hereby released from the lien of the real estate mortgage, executed by James A. and
Phyllis H. Platt on August 29, 1996, recorded in the records of the Office of the Recorder of
the County of Black Hawk, State of Iowa, in Book 511 of Land Mtg., at Pages 234 and 235.
Words and phrases herein, including acknowledgment hereof, shall be construed as
in the singular or plural, and as masculine, feminine or neuter gender, according to the
context.
