HomeMy WebLinkAboutMid American Energy Company-Responsibility Agreement-03.26.2007 . 3-a �-D7 March 6, 2007 Waterloo Fire Department ATTN: Ned DeBerg, Fire Chief—Waterloo Fire Department 425 E. 3rd street Waterloo, IA 50703 This letter of agreement establishes responsibilities for MidAmerican Energy Company and the Waterloo Fire Department (WFD)to ensure that any oil release within the scope of the Electrifarm Facility Response Plan (EFFRP) that discharges to, or threatens, surface water or adjacent shoreline of the Blackhawk Creek watershed is promptly addressed as required by the Clean Water Act, as amended by the Oil Pollution Act of 1990. MidAmerican Energy Company (MEC) will: 1. Provide a current copy of the EFFRP to WFD. 2. Provide a sufficient quantity containment boom as outlined in the EFFRP, and associated mooring equipment appropriate for use on small inland streams and adjacent shorelines. The equipment will be stored at the John Deere Waterloo Facility as outlined in the attached memorandum of agreement between MEC and the John Deere Corporation (JDC). 3. Provide technical support for EFFRP training and containment boom deployment during an actual emergency. 4. Provide funding for annual EFFRP/containment boom deployment training for designated WFD personnel. Waterloo Fire Department will: 1. Deploy the containment boom, as outlined in the EFFRP, within one hour of the initial call for emergency spill response services on Blackhawk Creek. Equipment will be stored and deployed across Blackhawk Creek at the John Deere Waterloo Facility as outlined in the attached memorandum of agreement between MEC and the John Deere Corporation (JDC). 2. Obtain appropriate training on containment boom deployment as specified in "Training Reference for Oil Spill Response" (USCG-X0188) prepared by the Department of Transportation, Environmental Protection Agency and the Department of Interior. 3. Conduct an annual EFFRP/containment boom deployment training exercise as required by Title 40 Code of Federal Regulations Part 112.21 and the National Preparedness for Response Exercise program (OPA-90/ 33USC1321(j)). The exercise shall be conducted on Blackhawk Creek at the John Deere Waterloo Facility. Page 1 of 2 4. Obtain appropriate authority for the signatory, below, to execute this agreement on behalf of the Waterloo Fire Department. 5. Waterloo Fire Department will submit an itemized list of reasonable costs incurred for training, drills, and hazmat spill response to MEC for reimbursement. The parties to this agreement hereby agree that all above references to regulations and publications shall be construed to be references to the latest version/latest edition of each such regulation or publication as time progresses. Either party may terminate this agreement by giving the other party three (3) months written notice. If the termination be for cause, either party may terminate the agreement by giving the other party seven(7) days written notice. Please indicate your acceptance of these responsibilities by signing this letter and returning a copy to me. This agreement will be effective on the date signed.
