EFFECTIVE DATE: February 14, 2007
THIS AMENDMENT is made by and between the VISION IOWA BOARD, (hereafter "Board"),
200 East Grand Avenue, Des Moines, Iowa 50309, an agency of the State of Iowa, and the City
of Waterloo, 715 Mulberry Street, Waterloo, IA 50703 and H.W. Grout Trust, 503 South Street,
Waterloo, IA 50701 and City of Cedar Falls, 220 Clay Street, Cedar Falls, IA 50613 (hereafter
"Contractor"),
Contractor, by correspondence dated February 12, 2007, requested that the contract be
amended to extend the time allowed to provide funding documentation to January 16,2007.Contract
Number 01-VI-010 is hereby modified as follows:
7.1.2 All Recipients shall obtain, to the satisfaction of the Board, all other legally binding
financial commitments necessary to complete the Project, as set forth on Exhibit D. Failure to
obtain and submit documentation of the binding commitments to the Board within three hundred
sixty(360) days of the execution of this Agreement by January 16, 2007 shall be grounds for
termination of this Agreement. The Board agrees that,with respect to the Grout Component, it
shall accept a commitment by Waterloo, approved by resolution of the city council of Waterloo
and in form and content reasonably satisfactory to the Board, as a legally binding financial
commitment for purposes of this Section 7.1.2, if Grout elects to include such a commitment
among its legally binding financial commitments.
Except as otherwise revised above, the terms,provisions, and conditions of Contract
Number 01-VI-010 remain unchanged and are in full force and effect:
