Director of Aviation Waterloo Regional Airport 2790 Livingston Lane Waterloo, IA 50703 RE: Rehabilitation of Runway 12-30 Waterloo Regional Airport City of Waterloo,Iowa FAA AIP Project No. 3-19-0094-29 Earth Tech ID No. 91933 Dear Mr. Hagen: By this letter, we are hereby requesting consideration of a modification to our agreement for construction phase services for the above-mentioned project. Several situations occurred during construction that have caused us to exceed our original scope of services and budget estimate. The major areas where we have exceeded our scope of services are listed below. 1. MALS Threshold Light Bar— During design, we included the removal and replacement of the MALS Threshold Light Bar at the northwest end of the runway because that threshold light bar was the cause of noted deviations of standards. This item of work was not specifically identified to the FAA until the final plans were presented for review. As part of the review process, we were directed to delete this work from the contract or proceed without federal funding. We made an attempt to work with the local sector office in order to get the work made eligible under this project. This effort failed and the FAA granted a waiver for the end elevations of the Runway. As a result, we were directed to revise the plans to incorporate the MALS Threshold Light Bar into the final project by changing the grades in the last 50 feet of the runway adjacent to the MALS Threshold Light Bar. 2. Friction Measuring Device—We were asked to assist with the acquisition of a friction measuring device for the Waterloo Airport as part of this federal grant. Initially, we thought this would be a very simple exercise. Unfortunately, it has turned into an extended effort with much coordination with FAA required. There are four FAA approved manufacturers of decelerometers. We received a price from one supplier to establish an amount for the grant for this project. This was approved by FAA with a note that it must be the lowest priced unit. As a result, we did additional research and found that none of the approved decelerometers are the same and that only three are actually made. We presented a justification concept to the FAA for the purchase of a unit, only to be informed that the Airport was required to receive written quotes from each vendor and are required to award to the lowest quote received. • Mr. Bradley Hagen EarthTech 3/23/2007 A Tyco International Ltd.Company Page 2 3. Rotating Beacon — Since the beacon has recently become inoperable and the FAA has indicated that replacement would be considered, we are preparing a site plan and specification for installation of a new beacon for the Airport. The installation will be added by Change Order to the Part 139 Signage project. 4. Materials Testing—The bituminous materials testing for acceptance was completed by Braun Intertec as a sub-consultant to us. Their original agreement with us was for one day of testing for a test strip and up to 15 continuous days of testing during production. The actual production schedule was as follows: a. August 16—Wednesday-one-half of test strip b. August 18—Friday-one-half of test strip c. August 30—Wednesday- surface overlay d. August 31 —Thursday- surface overlay e. September 1 —Friday- surface overlay f. September 5 —Tuesday- surface overlay g. September 15—Friday-surface overlay h. September 19—Tuesday-surface overlay i. September 20—Wednesday- surface overlay j. September 22—Friday-surface overlay k. September 25—Monday- surface overlay 1. September 26—Tuesday-surface overlay m. October 4—Wednesday-access road and runway end As a result of the non-continuous paving operation, the testing lab incurred additional cost in order to provide the acceptance testing required for the project. 5. Temporary Paint—As a result of the paving operation not being completed until the end of September, the original specified paint(Polyurea) could not be placed on the runway surface. As a result, we had to establish an alternate solution, get it approved, and coordinate with the paint contractor in order to complete the temporary painting prior to the grooving operation but after a required cure time of 30 days. 6. Project Completion—Due to the Contractor's late completion of the paving operations, the project was not completed during the 2006 construction season. Some corrective action and the final pavement marking will have to be completed in 2007. As a result of this unanticipated extension of the anticipated completion date additional construction review and coordination are required. The construction contract will be evaluated to determine if the Contractor should be charged liquidated damages for this late completion of the project. We have reviewed the additional work as a result of the above items and have prepared the attached estimate of hours and cost for the completion of the project. This amendment increases the Maximum Amount Payable by Twenty One Thousand Seven Hundred ($21,700.00) Dollars. With this amendment included, we believe that the total project cost will still be within the original grant amount.
