AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
WATERLOO, IOWA, BY REPEALING SUBSECTIONS 23-36 THROUGH 23-41
OF DIVISION 3, PEDDLERS AND SOLICITORS, OF CHAPTER 23, LICENSES
AND BUSINESS REGULATIONS, AND ENACTING IN LIEU THEREOF NEW
SUBSECTIONS 23-36 THROUGH 23-41.4 OF DIVISION 3, PEDDT.RRS AND
SOLICITORS, OF CHAPTER 23, LICENSES AND BUSINESS REGULATIONS.
BE IT ORDAINED By the City Council of the City of Waterloo, Iowa:
That Subsections 23-36 through 23-41 of Division 3, Peddlers and Solicitors,
of Chapter 23, Licenses and Business Regulations, of the Code of Ordinances
of the City of Waterloo, Iowa, are hereby repealed in their entirety; that
new Subsections 23-36 through 23-41.4 of Division 3, Peddlers and Solicitors,
of Chapter 23, Licenses and Business Regulations, of the of Ordinances

of the City of Waterloo, Iowa, are hereby enacted in lieu thereof as follcw s:
Sec. 23-36. Activities exempt from division.
The provisions of this division shall not apply to persons who offer
for sale products of their own raising, articles of their own manufacture,
or food products shipped in carload lots for sale or delivery from said
cars, nor shall it apply to the sale of milk.
Sec. 23-37. Definition.
The term "peddler" shall mean any person carrying goods or merchandise
who sells or offers for sale for immediate delivery such goods or merchandise
or takes orders for goods, subscriptions or merchandise to be delivered at
a future date.
Sec. 23-38. Application for a license.
An application in writing shall be filed with the city clerk for a license
under this ordinance. Such application shall set forth the applicant's name,
permanent and local address, business address, if any, physical description,
and be accompanied by a certificate that the applicant is in good health and
free from contagious diseases, signed by a local p h sician. The application
also shall set forth the applicant's employer, if any, and the employer's
address, the nature of the applicant's business, and last three (3) places
of such business.
A fee of $5.00 shall be paid at the time of filing such application to
cover the cost of investigating the facts stated therein.
Sec. 23-39. Issuance of the license.
If the city clerk finds the application is made out in conformance with
Subsection 23-38 of this ordinance and the facts stated therein are correct,
he shall issue a license and charge a fee therefor as determined by Subsection
23-40 of this ordinance. If the city clerk denies the applicant, the applicant
may appeal to the city council for a license.
Sec. 23-40. Fees.
Every licensee shall pay a $10.00 fee before a license shall be issued.
The license will be valid for a period of one year.
SeC. 23-41. Display of license.
Each peddler shall at all times while doing business in this city keep
in his possession the license provided for in Subsection 23-39 of this
ordinance, and shall, upon the request of prospective customers, exhibit the
license as evidence that he has complied with all requirements of this
ordinance.
Sec. 23-41.1. License not transferable.
Licenses issued under the provisions of this ordinance are not trans-
ferable in any situation and are to be applicable only to the person filing
the application.

Sec. 23-41.2, Revocation of license.
The city council, after notice and hearing, may revoke any license
issued under this ordinance where the licensee in the application for the
license or in the course of conducting his business has made fraudulent
or incorrect statements or has violated this ordinance or has otherwise
conducted his business in an unlawful manner.
Sec. 23-41.3. Expiration of license.
All licenses granted under this ordinance shall expire at 8:00 p.m.
of the last day for which the license is issued.
Sec. 23-41.4. Limitation on time for peddling.
No person shall peddle goods or merchandise from 8:00 p.m. until
8:00 a.m. the following day.
