AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
WATERLOO, IOWA, BY REPEALING ALL OF SECTION 16-8 (FEE FOR SERVICE;
PENALTY FOR LATE PAYMENT; REIMBURSEMENT) AND SUBSECTION (a) OF
SECTION 16-9 (COLLECTION OF FEES; DISCONTINUANCE FOR FAILURE TO
PAY, DISPOSITION OF PROCEEDS); OF CHAPTER 16, GARBAGE AND REFUSE;
AND ENACTING IN LIEU THEREOF NEW SECTION 16-8 (FEE FOR SERVICE;
PENALTY FOR LATER PAYMENT; EXEMPTIONS) AND NEW SUBSECTION (a) UNDER
SECTION 16-9 (COLLECTION OF FEES; UNPAID FEES ASSESSED TO PROPERTY;
DISPOSITION OF PR(XEEDS) OF CHAPTER 16, GARBAGE AND REFUSE.
BE IT ORDAINED by the City Council of the City of Waterloo, Iowa, that:
Section 1.
That Section 16-8 (Fee for service; penalty for late payment, reimbursement)
of Chapter 16, Garbage and Refuse, of the Code of Ordinances of the city of
Waterloo, Iowa, is hereby repealed in its entirety; that new Section 16-8
(Fee for service; penalty for late payment; exemptions) is hereby enacted
in lieu thereof as follows:
'Sec. 16-8. Fee for service; penalty for late payment; exemptions.
(a_
(a) All dwelling units within the City of Waterloo shall be charged
the sum of $3.30 per month for garbage pickup. However, a dwelling
unit may be taken off the monthly billing for garbage pickup if the
owner or occupant of the dwelling unit complies with one of the
following exemptions:
(1) That the occupant of the dwelling unit has a gross
annual income of less than $7,000.00,
(2) That the owner or occupant of the dwelling unit has
contracted with a private licensed collector of garbage
or refuse material, or
(3) That the owner or occupant is hauling his own garbage
from the dwelling unit to a properly designated landfill
or other proper method of disposing of the garbage or
refuse material.
(b) In order to be granted an exemption as set out in Paragraph (a)
above, the owner or occupant shall make an application for exemption
with the City clerk annually with the exemption to be based on a
calendar year basis.
(c) There shall be assessed a penalty of five (5) per cent if the
bill for garbage and refuse service is not paid at the time indicated
on the bill.
(d) The city may change and readjust the garbage and refuse service
fee from time to time as it becomes necessary so as to be sufficient
in each year for the payment of expenses of operation and for repair,
Maintenance and replacement of garbage and refuse equipment.
Section 2.
That Subsection (a) under Section 16-9 (Collection of fees; discontinuance
for failure to pay, disposition of proceeds) of Chapter 16, Garbage and
Refuse, of the Code of Ordinances of the City of Waterloo, Iowa, is hereby
repealed in its entirety; that new Subsection (a) under Section 16-9
(Collection of fees; unpaid fees assessed to property; disposition of
proceeds) is hereby enacted in lieu thereof as follows:
"Sec. 16-9. Collection of fees; unpaid fees assessed to property;
disposition of proceeds.
(a) The municipal water works office is hereby authorized and
directed to renderaand collect fees or service charges for garbage

and refuse service in accordance with ale fees established in
section 16-8 of this article. The charge shell be collected with
the consumer's regular monthly and/or quarterly water and sewer
bill, and shall be shown as a separate item on the bill. The
owner or manager of a dwelling unit or multiple dwelling who provides
and pays for the water and sewer consumption charges of his tenants
shall also be responsib&e and pay for the garbage and refuse service
charge of his tenants. Collection policies shall be the same as the
other city utility services. When a fee is six months delinquent,
the unpaid fee for city garbage and refuse service shall be assessed
against the property benefited as provided for under Section 420.190
of the Code of Iowa. Amounts collected for the garbage and refuse
service shall be deposited in the solid waste collection appropriation
of the general fund of the city.
