AN ORDINANCE AMENDING CHAPTER 34, SEWERS, ARTICT,F III , OF THE CODE OF ORDINANCES OF THE CITY OF WATERLOO, BY REPEALING SECTIONS 34-27, DEFINITIONS, SECTION 34-53, "DOMESTIC SEWAGE" DEFINED, AND SECTION 34-54, BASIC CHARGE AND RATES ESTABLISHED; BASIS OF DETERMINATION; INCREASE OF RATES AND CHARGES FOR DELINQUENT PAYMENTS, AND ENACTING IN LIEU THEREOF SECTION 34f►27, DEFINITIONS, SECTION 34-53, "DOMESTIC SEWAGE" DEFINED, AND SECTION 34-54, BASIC CHARGE AND RATES ESTABLISHED; BASIS OF DETERMINATION; INCREASE OF RATES AND CHARGES FOR DELINQUENT PAYMENTS. BE IT ORDAINED by the City Council of the City of Waterloo, Iowa: That Section 34-27, Definitions, Section 34-53, "Domestic sewage" defined, and Section 34-54, Basic Charge and rates established; basis of determination; increase of rates and charges for delinquent payments, of Article III, of Chapter 34, of the Code of Ordinances of the City of Waterloo, Iowa, are hereby repealed in their entirety; that new Sections 34-27, Definitions, Section 34-53, "Domestic sewage" defined, and Section 34-54, Basic charge and rates eatablished; basis of determination; increase of rates and charges for delinquent payments, of Article III, Chapter 34, Sewers, of the Code of Ordinances, of the City of Waterloo, Iowa, are hereby enacted in lieu thereof as follows: Sec. 34-27. Definitions. As used in this article, the following terms shall have the meanings ascribed to them: 1. B.O.D. denotes biochemical oxygen demand and shall mean the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five (5) days at twenty (20) degrees centigrade, expressed in parts per million by weight. 2. Combined sewer shall mean a sewer receiving both surface runoff and sewage. 3. Garbage means solid wastes from the preparation, cooking and dispensing of food, and from the handling, storage and sale of produce. 4. Industrial user shall mean any nongovernmental user of publicly owned wastewater facilities identified in the Standard Industrial Classification Manual, 1972, Office of Management and Budget as the same may now or hereafter be amended and supplemented under the following divisions: (a) Division A - Agriculture, Forestry and Fishing (b) Division B - Mining (c) Division C - Manufacturing (d) Division D - Transportation, Communication, Electric, Gas and Sanitary Services (e) Division E - Services A user in the Divisions listed may be excluded as an industrial user if it is determined by the Superintendent such user will introduce into the wastewater systems primarily segregated domestic waste or waste from sanitary conveniences rather than industrial waste. 5. Industrial wastes shall mean the liquid wastes from industrial processes as distinct from sanitary sewage. 6. Natural outlet means any outlet into a watercourse, pond, ditch, lake or other body of surface or groundwater. 7. pH means the logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution. 8. Properly shredded garbage means the wastes from the preparation, cooking and dispensing of food that has been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half (1/2) inch in any dimension. 9. Public sewer means a sewer in which all owners of abutting properties have equal rights, and which is controlled by the council. 10. Sanitary sewer means a sewer which carries sewage and to which storm, surface and groundwaters are not intentionally admitted. 11. Sewage means a combination of the water-carried wastes from residences, business buildings, institutions and industrial establishments, together with such ground, surface and storm water as may be present. 12. Sewage works shall mean all facilities for collecting, pumping, treating, and disposing of sewage. 13. Sewer shall mean a pipe or conduit for carrying sewage. Page 2 14. Storm sewer or storm drain means a sewer which carries storm and surface waters and drainage, but excludes sewage and polluted industrial wastes. 15. Superintendent shall mean the superintendent of sewers of the city, or his authorized deputy, agent, or representative. 16. Suspended solids means solids that either float on the surface of, or are in suspension in, water, sewage, or other liquids and which are removable by laboratory filtering. 17. Watercourse means a channel in which a flow of water occurs, either continuously or intermittently. 18. Water pollution control plant means any arrangement of devices and structures used for treating sewage. Sec. 34-53. "Domestic sewage" defined. As used in this division, domestic sewage shall mean any sewage having a B.O.D. not more than three hundred (300) parts per million, and suspended solids (S.S. ) of not more than three hundred fifty (350) parts per million, and containing no such chemical or other substance as would interfere with the proper operation of the water pollution control plant. Sec. 34-54. Basic charge and rates established; basis of determination; increase of rates and charges for delinquent payments. Each and every lot, parcel or real estate or building or premises situated within or without the city that is connected with and uses the sewer outlet and purifying plant of the city, by or through any part of the sewage system of the city, or that in any way uses or is served by a sewer outlet and the purifying plant or otherwise discharges sanitary sewage, industrial waste, water or other liquid, either directly or indirectly, into the sewerage system of the city, shall pay a service charge, rate or rental to the city in accordance with the following schedule: (a) The maximum quarterly rate shall be based on one hundred (100) per cent of water consumption during the winter quarter as recorded by the Waterloo Water Works. A winter quarter water bill is a bill that is submitted for three (3) months, covering the months of November, December, January, February, March, and April or any portion thereof. Those users of water being billed on a monthly basis by the Waterloo Water Works, the maximum monthly rate shall be based on one hundred (100) per cent of the average water consumption for the months of December, January, and February as recorded by the Waterloo Water Works. Industrial users will be billed on actual water consumption rather than winter consumption unless winter consumption is approved by the Superin- tendent. Any special or private contracts shall be metered at the user's expense. (b) Users who have their own private wells shall pay a minimum charge as computed by the Waterloo Water Works unless notified by the superintendent of the water pollution control plant that the users must comply with section 34-56. (c) Users who are located outside of the limits of the city, shall pay double the rates specified in this section. (d) If the rates as specified in this division are not paid when due as required by this division, there shall be added to the rates a penalty of five (5) per cent. The clerk shall certify to the county auditor all sewer rates, charges, or rentals and penalties delinquent. (e) A surcharge for waste waters or other sewage having a B.O.D. of more than three hundred (300) parts per million, or more than three hundred fifty (350) parts per million suspended solids, and containing no such chemical or other substances as would interfere with the proper operation of the purifying plant, shall be computed according to the following formula: Flow A/12 x .33 x :B1 = Cf BOD A/12 x .33 x B2 = CBOD SS A/12 x .33 x B3 = Css Total monthly assessment = C. A = Annual budget minus debt service, collection costs, bond retirement, and reserve fund. Page 3 B1 = Industry's share of the plant flow calculated during the month. B2 = Industry's share of the plant's B.O.D. loading, calculated from samples taken during the month. B3 = Industry's share of the plant's SS loading, calculated from samples taken during the month. (f) The rates for sewer service charges shall be established from time to time by City Council ordinance.
