SUB-SECTION NO. 1 TO SECTION 2A-7-M, CONDI-
T I ONLL ZONING.
BE IT ORD.3.INED BY THE COUNCIL OF THE CITY OF `' :TFRLOO,
IOWA:
Section 1. That Sub-section No. 130 of Section 27x-5 of
Ordinance No. 2479, as amended be repealed in its entirety
and the following new Sub-section 1 be added to Section
2A-7-M, Conditional zoning:

now zoned on the Zoning Map of Waterloo, Iowa, as "R-2" One
and Two Family Residence District , be and the same is hereby
zoned as Conditional in a R-2 One and Two Family Residence
District .
Section 2. That the City Clerk be, and he is hereby directed
to file a certified copy of this Ordinance with the Recorder
of Black Hawk County, Iowa.
Passed and adopted by the City Council on 18th day of
August , 1980, approved by the Mayor on the 20th day of ,-ugust ,
1980.

CCND:ITIONAL ZONING AGREEMENT
This Agreement is entered into between a representative of Afro-American
Camunity Broadcasting, Inc. and the City of Waterloo.
This Agreement is in conjunction with the request for Conditional Zoning
approval for the purpose of building and operating a non-profit educational
FM radio transmitter and the erection of an antenna to serve the radio station
in an "R-2" One and Two Family Residence District on property legally described
as Lot 10, Block 7 in Auditor Francis Rose Hill Plat in the City of Waterloo,
Black Hawk County, Iowa, and commonly known as 521 Cottage Street.
In conjunction with the operation of a radio station on the above described
property, the following conditions are agreed upon:
1) The height of the tower will not be allowed to exceed 200 feet;
2) If the transmitter creates interference of neighbors' radios and
televisions, the interference shall be eliminated or the radio
station will be requested to be relocated; and
3) A statement signed by a licensed engineer stating the project is
safe as designed be submitted prior ,.:.o issuance of a building
permit.
