RESOLUTION NO. 2024-543
RESOLUTION APPROVING THE REQUEST OF DAN NOEL,
FOR A WAIVER FOR AN ASPHALT DRIVEWAY, LOCATED
AT 215 N. HACKETT ROAD, AND AUTHORIZING THE
CONSTRUCTION OF A CONCRETE DRIVEWAY AND
PLACING A DRIVEWAY OR SIDEWALK ON THE CITY
RIGHT-OF-WAY ON AN UNIMPROVED STREET.
WHEREAS, the City Engineer has made a written application to the City Council asking
that Dan. Noel, be authorized and permitted to construct an asphalt driveway, with the
elimination of the sidewalk section for asphalt driveways, located at 215 N. Hackett Road, and
legally described as follows:
AUDITOR WHITNEY ROAD PLAT CASTLE HILL PART OF
LOT 61 COM ON E LINE OF LOT 172.7 FT S OF NE COR TH
W 120 FT TH S 75 FT TH E 120 FT TH N 75 FT TO BEG, IN
BLACK HAWK COUNTY, IOWA.
WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request
should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted
to Dan Noel, to construct an asphalt driveway, with the elimination of the sidewalk section for
asphalt driveways, located at 215 N. Hackett Road subject to the following conditions:
1. Work is to be performed by an approved and bonded contractor.
2. A permit is to be obtained from the office of the City Engineer prior to
construction.
3. All work shall be under the supervision of the City Engineer and at no cost
to the City of Waterloo.
BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to forward
a certified copy of this resolution to the Black Hawk County Recorder for recording and the
Black Hawk County Auditor for filing in order that this said action may become a matter of
official County Record.
PASSED AND ADOPTED this 16t'' day of September 2024.
