RESOLUTION NO. 2024-562 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CITY -OWNED PROPERTY LOCATED NORTHWEST OF 2765 CROSSROADS BOULEVARD TO GRANT PARK, LLC, IN THE AMOUNT OF $1.00, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENTS. WHEREAS, the City of Waterloo, Iowa is the owner of property located northwest of 2765 Crossroads Boulevard, in the City of Waterloo, Iowa, and legally described as follows: PARCEL "G" ACCORDING TO PLAT OF SURVEY RECORDED FEBRUARY 9, 2024 AS DOC. NO. 2024-9902, BEING A PART OF THE SOUTHEAST QUARTER (SE 1/4), SECTION 2, TOWNSHIP 88 NORTH (T88N), RANGE 13 WEST (R13W) OF THE 5TH PRINCIPAL MERIDIAN (5TH PM), CITY OF WATERLOO, BLACK HAWK COUNTY, STATE OF IOWA, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHWESTERLY CORNER OF LOT A-2, CROSSROADS PLAT NO. 4, BEING A FOUND 1/2" REBAR WITH PLASTIC CAP AND LICENSE NUMBER 7811; THENCE NORTH 47°56'51" EAST 52.19 FEET ALONG THE NORTHWESTERLY LINE OF SAID LOT TO THE POINT OF BEGINNING OF THIS DESCRIPTION; THENCE CONTINUING NORTH 47°56'51" EAST 174.13 FEET ALONG THE NORTHWESTERLY LINE OF SAID LOT TO THE NORTHEASTERLY CORNER OF SAID LOT A-2; THENCE NORTH 41°55'56" WEST 50.00 FEET ALONG THE NORTHWESTERLY EXTENSION OF THE NORTHEASTERLY LINE OF SAID LOT A-2; THENCE SOUTH 47°56'51" WEST 174.19 FEET ALONG A LINE PARALLEL WITH AND 50.00 FEET DISTANT FROM THE SAID NORTHWESTERLY LINE OF LOT A-2 TO THE NORTHWESTERLY EXTENSION OF THE NORTHEASTERLY LINE OF THAT PART OF LOT A-2 AS LAST DESCRIBED IN A WARRANTY DEED FILED AS DOCUMENT NUMBER 2015-8506 IN THE OFFICE OF THE BLACK HAWK COUNTY RECORDER; THENCE SOUTH 41°59'43" EAST 50.00 FEET ALONG SAID NORTHWESTERLY EXTENSION TO THE POINT OF BEGINNING CONTAINING 8,708 SQUARE FEET (0.1999 ACRES), SUBJECT TO THE RETENTION OF A PUBLIC UTILITY EASEMENT OVER THE NORTHWESTERLY 10 FEET OF SAID PARCEL. WHEREAS, an offer to purchase said city -owned property, in the amount of $1.00 has been made by Grant Park, LLC, and WHEREAS, a public hearing was held on September 16, 2024, at 5:30 p.m. in the Harold E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa, to Grant Park, LLC, and WHEREAS, it is the opinion of this Council that the sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY Resolution 2024-562 Page 2 OF WATERLOO, IOWA, AS FOLLOWS: 1. The city -owned property located northwest of 2765 Crossroads Boulevard, in the City of Waterloo, Iowa, as fully described in the published notice in the Waterloo Courier on September 10, 2024, is not presently needed, and will not be needed in the foreseeable future for municipal purposes, and its ownership is serving no municipal purpose. 2. That the offer of Grant Park, LLC to purchase the city -owned property, located northwest of 2765 Crossroads Boulevard, known as Parcel "G", in the amount of $1.00, is hereby accepted for said property. 3. That the City of Waterloo, Iowa is conveying said property by quit claim deed. 4. That the Mayor and City Clerk are authorized and directed to execute said deed. 5. That the original of said quit claim deed, fully executed and acknowledged, is hereby approved and confirmed by this Council. 6. That the Community Planning and Development Director is authorized and directed to convey said property to Grant Park, LLC, upon execution of said deed and receipt of payment of $1.00.
