AN ORDINANCE AMENDING ORDINANCE NO. 247, ,AS AMENDT1D,KNOWN AS THE
ZONING ORDINANCE,BY ENACTING A NEW SECTION KNOWN AS 2A-48(J) & 2A-48(K)
EXCEPTIONS AND MODIFICATIONS ,UNDER PART XXII ,EXCEPTIONS IND
MODIFICATIONS.

WATERLOO,IOWA:
That Section 2A-48 (J) Exceptior.s and Vodifications,
under Part XXII,Lyception. anti Modifications ,of the Zoning Or-
dinance, is hereby enacted as follows :
" (J) Any lot which does not meet the mininum lot width
requirements of its zoning district may appeal said
lot width requirement to the board of Adjustment,where
sufficient hardship will need to be proven to 7art
a variance. "anu
That Section 2A-48 (K) Excepticns and Modifications ,
under Pelt XXII,Excepticns and Nodificaticus ,of the Zoning,
Grtiinance is hereby enacted as follows :
" (K) Any residential area where lots have been platted
and/or developed with lot widths less than the
minimum requirements of this ordinance,may,if they
have sufficient property to do so,subdivide their
property to create lots of similar size subject to
the ioard of Adjustment approval and finding that
the lots to be created at lesser requirements are
similar to those existing in the area.The size of the
lots would be determined by averaging all lot widths
within a two hundred fifty (250) foot radius of the
lot or lots to be suldivided.The lot or lots to be
subdivided will not be allowed to he reduced to less
than the average lot-Vidth.All lots including
the original lot or lots so subdivided must meet all
other applicable yard requirements."
