WHEREAS, the City of Waterloo, Iowa has undertaken the West
s c Fourth Street Reconstruction Project and the parcels of land hereinafter
�; `'described have been appraised and an offer made to the owners of said
_- property in the amount of the appraised value and said offer has been
refused and funds are available with which to pay for the said parcels

• Easement, or Fee Simple Title of the hereinafter described real property
is necessary in connection with the said West Fourth Street Recon-
struction Project.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
, OF WATERLOO, IOWA, that the following described parcels of real property
be acquired by condemnation in the manner provided by law, and such
other further action as may be necessary to effect acquisition by
Temporary Easement, Permanent Easement or Fee Simple Title.

The Southeasterly Seventeen (17) feet in even width of the Northwesterly Fifty (50) feet of
that parcel as recorded in Land Deed Book 537 Page 668 in the Black Hawk County Recorder's Office
said parcel being described as follows:
"Commencing at a point in the centerline of West Fourth Street, formerly U.S. Highway No. 63
that is Seven Hundred Fifty (750) feet Northeasterly of the Southwest corner of said North Half;
thence Southeasterly at right angles to said centerline a distance of Two Hundred Sixty-two (262)
feet; thence Northeasterly parallel with said centerline a distance of One Hundred Thirty-nine

TEMPORARY CONSTRUCTION EASEMENT ' V.I.,
That part of the Southeast Quarter (SE') of the Southeast Quarter (SEA) of Section Thirty-
three (33) , Township Eighty-nine North (T89N) , Range Thirteen West (R13W) of the Fifth Principal
Meridian in the City of Waterloo, Black Hawk County, Iowa, described as follows:
The Northwesterly Seventeen (17) feet in even width of the Southeasterly Fifty (50) feet of
that parcel as recorded in Land Deed Book 535 Page 390, Black Hawk County Recorder's Office to
wit:
"The Southwest One Hundred Seventy (170) feet in even width of part of the Southeast Quarter
of the Southeast Quarter of Section No. Thirty-three (33) in Township No. Eighty-nine (89) North,
Range No. Thirteen (13) West of the Fifth Principal Meridian, in Black Hawk County, Iowa, said
One Hundred Seventy (170) feet lying Southeasterly of a line which is One Hundred Forty-one (141)
feet normally distant from, Northwesterly of and parallel to the centerline of the Waterloo and
Eldora Road (now West Fourth Street) , said part being described as follows: Commencing at the
Northwest corner of said Southeast Quarter of the Southeast Quarter, running thence South along
the West line of said Southeast Quarter of the Southeast Quarter, Six Hundred Eighty-nine and
Five Tenths (689.5) feet to a point which is Three Hundred Ten and Thirty-two Hundredths (310.32)
feet North of the intersection of said West line of the Southeast Quarter of the Southeast Quart('
with the centerline of the Waterloo and Eldora Road; thence East on a line parallel with the Nord-
line of said Southeast Quarter of the Southeast Quarter, Four Hundred Twenty-one and Three Hun-
dredths (421.03) feet to the centerline of said Waterloo and Eldora Road; thence Northeasterly
along the centerline of said Waterloo and Eldora Road, One Hundred Twenty-three and Seventy-five
Hundredths (123.75) feet to the place of beginning. From said place of beginning running North-
westerly Three Hundred Thirty-two and Four Tenths (332.4) feet on a line which, if produced, will
intersect the North line of the said Southeast Quarter of the Southeast Quarter Thirty (30) feet
East of the Northwest corner thereof; thence East to a point in the centerline of said Waterloo
and Eldora Road which is Four Hundred Thirty-six and Five Hundredths (436.05) feet Northeasterly
of the place of beginning; thence Southwesterly on the centerline of said Road, to the place of
beginning."
Said easement terminates .
