AND ELAINE KAY GEIGER PLUS COSTS AND AUTHORIZING THE MAYOR AND CLERK/AUDITOR TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real oronerty in the sum of $140.00 plus costs has been made by Gene D. and Elaine Kay Geiger, and WHEREAS, a public hearing was held march 17, 1986 at 7:00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on proposal to sell and convey premises owned by the City of Waterloo, Iowa to Gene D. and Elaine Kay Geiger, Waterloo, Iowa, and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA AS FOLLOWS: 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on February 28, 1996, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of $140.00 and costs he, and it is hereby accepted for real property described below: That part of a sixteen (15) foot alley commencing at the southeast corner of Lot No. One, Stoyanoff's Replat, Waterloo, 91ack Hawk County, Iowa: thence west alone the south lot line of Lots One (1) and Two (2) of Stoyanoff's Replat a distance of seventy-five (75) feet; thence south at right angle a distance of eight (9) feet: thence west and parallel to the south lot line of Lot No. 2 of Stoyanoff's Replat a distance of twenty-five (25) feet: thence south at right angle a distance of eight (8) feet to the northwest corner of Lot Thirteen (13), Stoyanoff's Replat: thence east along the north lot line of Lots Thirteen (13) and Fourteen (14) of Stoyanoff's Reolat a distance of 100 feet: thence north to the point of beninnina. A public utility easement shall he retained over, under and upon the above described parcel. 3. That the City of Waterloo, Iowa, convey said parcels of real property to Gene D. and Elaine Kay Geiger by Quit Claim Deed. 4. That the Mayor and Clerk/Auditor are hereby authorized to execute and deliver deeds to Gene D. and Elaine Kay Geiaer. 5. That the Clerk/Auditor is authorized and directed to deliver said deed of conveyance to Gene D. and Elaine Kay Geiger upon receipt of the sum of S140.00 and costs.
