RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CERTAIN
EXCESS PROPERTY TO SECURITY
AUTHORIZINGNTHEUMAYOR AND AUTO
DEPUTYWORKERS
LOCAL 838 PLUS COSTS AND
CLERK/AUDITOR TO EXECUTE AND DELIVER A DEED FOR SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the
x city of Waterloo, Iowa, as described below, and

N-QW THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF
1—WATERLOO, IOWA AS FOLLOWS:
S- 1. The following described real property, as fully described in the
n m cpblished notice in the Waterloo Courier on March 24, 1986, is not
m °Cpesently needed and will not be needed in the foreseeable future for

p Ervnicipal purposes and its ownership is serving no municipal purpose, and

2. That the offer of $60,000 and costs be, and it is hereby accepted

EXHIBIT "A"
A parcel of land located in the NE 1/4 of the SE 1/4 of Section 36
T89N, R13W of the 5th P.M. , Black Hawk County, Iowa described as
follows:
Commencing at the NW corner of the NE 1/4 of the SE 1/4 said Section
36; thence N 89° 05' E 291.7 feet along the North line of the NE 1/4
of the SE 1/4 said Section 36; thence S 00° 55' E 51.3 feet; thence
S 01° 16 1/2' E 275.2 feet; thence S 10° 14 1/2' W 46.8 feet; thence
S 03° 17 1/2' E 265 feet to the point of beginning; thence S 03° 17
1/2' E 357 feet; thence S 19° 15 1/2 ' E 87 feet; thence N 89° 13
1/2' E to the West line of railroad right of way; thence N 21° 20
1/2' W to a point 435 northwesterly of the North line of Easton
Avenue; thence S 88° 55' W 360.0 feet; thence N 01° 03 W 60.0 feet;
thence N 85° 31 ' E 331.3 feet; thence N 21° 16 1/2 W 187.9 feet;
thence S 88° 53 1/2' W 423.3 feet; thence Westerly to the point of
beginning; containing 246,114 sq. feet or 5.65 acres.
The above property is subject to a 50 ft. wide sanitary sewer
easement described as follows:
The westerly 50 feet in even width of the East 318 feet as
measured parallel to Easton Avenue.
EXHIBIT "B"
1. This offer assumes the Flood Control Levee will not be
relocated; however, the buyer agrees to maintain the existing
elevation of the flood dike system intact.
2. The seller agrees to construct a public road from Mitchell
Avenue to the south property line of the Waterloo Mills property
and from Locke Avenue to the south property line as described in
Exhibit "A" above which will be an extension of Texas Street.
Said streets to be constructed in a similar design as existing
Texas Street.

3. The seller agrees that the adjacent property owned by the seller
which is located between the subject property and Easton Avenue
will not be used for the following purposes:
A. Welding or other metal working shops, excluding shops with
drop hammers and the like.
B. Contractor's equipment storage yard or plant, or rental of
equipment commonly used by contractors, storage and sale of
livestock, feed and/or fuel , provided dust is effectively
controlled, and storage yards for vehicles of a delivery or
draying service.
C . Circus, carnivals or similar transient enterprises; provided
such structures or buildings shall be at least two hundred
(200) feet from any "R" District.
D. Coal , coke or wood yard.
E. Concrete mixing, concrete products manufacture.
F. Livery stable or riding academy.
G. Sawmill, planning mill, including manufacture of wood
products not involving chemical treatment.
H. Auto salvage yard and/or junkyard.
3. That the City of Waterloo, Iowa, convey said parcels of real
property to Security House, Inc./United Auto Workers Local 838 by Quit
Claim Deed.
4. That the Mayor and Deputy Clerk/Auditor are hereby authorized to
execute and deliver deeds to Security House, Inc./United Auto Workers
Local 838.
5. That the Deputy Clerk/Auditor is authorized and directed to deliver
said deed of conveyance to Security House, Inc./United Auto Workers Local
838 upon receipt of the sum of $60,000 and costs.
Passed and adopted this 24th day of March, 1986.
