m RESOLUTION AUTHORIZING THE CONDEMNATION OF A CERTAIN
F PARCEL OF REAL PROPERTY FOR THE KIMBALL AVENUE PROJECT.

WHEREAS, the City of Waterloo, Iowa, has undertaken the
m Kimball Avenue Project and the parcel of land hereinafter described has
been appraised and an offer made to the owner of said�` property in the
amount of the appraised value and said offer has been refused and funds
are available with which to pay for the said parcel from City funds;
and
WHEREAS, the acquisition of the hereinafter described real
c., property is necessary in connection with the said Kimball Avenue

z NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the following described parcel of real
property be acquired by condemnation in the manner provided by law and
such other further action as may be necessary to effect acquisition:

DESCRIPTION:
PERMANENT FLOWAGE EASEMENT (PARCEL NO. 89)
A forty (40) foot Easement being twenty (20) feet on each side of a
Centerline crossing the Northeast Fractional Quarter (NE 1/4) of Section
Four (4) and the Northwest Fractional Quarter (NW 1/4) of Section Three
(3) , all in Township No. Eighty-eight (88) , Range Thirteen ( 13) West of
Fifth Principal Meridian , in the City of Waterloo, Black Hawk County, Iowa,
and said centerline described as follows:
Commencing at a point on the East property line of Kimball Avenue Two
Hundred Forty-six (246) feet North of the Northwest corner of Lot No. 1 ,
Southaven Addition; thence East parallel with the North Lot Line of Lot No.
1 , Southaven Addition , a distance of One Hundred ( 100) feet; thence
Southeasterly to a point Ten ( 10) feet East of the Northeast corner of Lot
No. 3 in Southaven Addition.
Containing approximately 17,087 sq. ft.
TEMPORARY GRADING EASEMENT (PARCEL NO. 89)
The West 20.00 feet except the East 10. 00 feet of the North 118. 00 feet of
the following described parcel :
That part of the Northwest Fractional Quarter of Section No. Three (3) and
that part of the Northeast Fractional Quarter of Section No. Four (4) in
Township No. Eighty-eight (88) North, Range No. Thirteen (13) West of the
Fifth Principal Meridian in the City of Waterloo, Black Hawk County, Iowa,
bounded as follows:
Commencing at the point of intersection of the South line of Ridgeway
Avenue as now established with the East line of Kimball Avenue as now
established; thence South along the East line of Kimball Avenue Five
Hundred Forty (540) feet to the point of beginning; thence South along the
East line of Kimball Avenue to the Northwest corner of Lot no. One ( 1 ) in
Southaven Addition, Waterloo, Black Hawk County, Iowa; thence East along
the North line of said Southaven Addition Three Hundred Eighty (380) feet;
thence North along a line which is parallel with the East line of Kimball
Avenue to a point which is Five Hundred Forty (540) feet South of said
South line of Ridgeway Avenue (as measured along said parallel line) ;
thence West to the point of beginning.
Containing approximately:
Temporary Grading Easement 8804 sq. ft.
Flowage Easement Overlap 800 sq. ft.
