RESOLUTION ACCEPTING FORTY (40) FT. SANITARY SEWER/
PUBLIC UTILITY EASEMENT LOCATED BETWEEN IOWA NORTHERN
RAILROAD AND WASHINGTON STREET AND NORTH OF VACATED
EASTON AVENUE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the following described property be and the same hereby
accepting as a sanitary sewer/public utility easement (located
between Iowa Northern Railroad and Washington Street and north of
vacated Easton Avenue) :
A Sanitary Sewer/Public Utility Easement described as
follows:
Commencing at the point of intersection of the northerly
line of vacated Easton Avenue and the easterly line of
I-380, thence N 89° 13' 30" E 341.53 feet to the point of
beginning, thence S 21° 10' E to the centerline of vacated
Easton Avenue thence south perpendicular to the right-of-
way of vacated Easton Avenue 33 feet to the south line of
vacated Easton Avenue, thence N 89° 13' 30" E 43.17 feet,
along said line, thence north perpendicular to the last
described course 33' to the centerline of vacated Easton
Avenue, thence N 21° 10' W to the north line of vacated
Easton Avenue, thence continuing on the last described
course a distance of 228.3 feet, thence S 89° 13' 30" W
43.17 feet, thence S 21° 10' E to the point of beginning.
ALSO a 40 foot wide sanitary sewer/public utility easement
described as follows:
Commencing at the northeast corner of the below described
property, thence westerly along the north line 250.5 feet
to the point of beginning, thence westerly on a continua-
tion of the last line 42.57' , thence S 21° 11 ' E to the
south line of property, thence N 89° 13' 30" E 43.17' ,
thence N 21° 11 ' W to point of beginning.
A parcel of land located in the NE 1/4 of the SE 1/4 of
Section 36 T89N, R13W of the 5th P.M., Black Hawk County,
Iowa, described as follows:
Commencing at the NW corner of the NE 1/4 of the SE 1/4
said Section 36: thence N 89° 05' E 291.7 feet along the
North line of the NE 1/4 of the SE 1/4 said Section 36:
thence S 00° 55' E 51.3 feet; thence S 01° 16 1/2 ' E 275.2
feet; thence S 10° 14 1/2' W 46.8 feet: thence S 03° 17
1/2' E 265 feet to the point of beginning; thence S 03° 17
1/2' E 357 feet; thence S 19° 15 1/2' E 87 feet; thence N
89° 13 1/2' E to the West line of railroad right of way:
thence N 21° 20 1/2' W to a point 435 northwesterly of the
North line of Easton Avenue; thence S 88° 55' W 360.0 feet;
thence N 01° 03' W 60.0 feet; thence N 85° 31' E 331.3
feet; thence N 21° 16 1/2' W 187.9 feet; thence S 88° 53
1/2' W 423.3 feet; thence Westerly to the point of
beginning.
