WHITE, AND AUTHORIZINR CONSTRUCTION OF ONE (1) TEMPORARY CONCRETE DRIVEWAY IRRESPECTIVE OF A LATTER OFFICIAL GRADE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: That, WHEREAS, Robert O. White has made written application to the City Council asking that he be authorized and permitted to construct one (1) temporary concrete driveway without respect to a permanent sidewalk grade when and if the same may be subsequently set on Unplatted Wfloo West nart of SW SE Sec. 35 T 89 R 13 PEG at pt in line drawn from pt in center line Locke Ave 786.1 ft. E of W line SE 1/4 of Sec to Pt in S line said Sec 782.95 ft E of SW cor SE 1/4 of Sec which pt of beg is 455.5 ft S of S line Locke Ave th S along first des line 56.5 ft th E to pt 4.52 ft W of W line E 105 rds of SE 1/4 Sec th N 56.5 ft th W to beg 35-089-013 known as 2520 W. 9th Street: and WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be aranted, now, therefore, BE IT FURTHER RESOLVED that permission is hereby granted to Robert O. White to construct one (1) temporary concrete driveway in accordance with the existina contour of the abutting land with the subjective understanding and agreement betweeh the City of Waterloo, Iowa, and the said Robert O. White that, should at a later date a permanent formal grade be established for sidewalk Purposes or otherwise, that the said Robert O. White will immedi- ately thereafter, and at his own expense, remove all or whatever portion of temporary concrete driveway he may have constructed, and rebuild or reconstruct the same in accordance with the Permanent grade as may hereafter be set and established, the work to be done under the supervision of the City Enaineer. BE IT FURTHER RESOLVED, that the Clerk/Auditor is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and for filing in order that this said action may become a matter of official County Record.
