RESOLUTION NO. 1986-423 RESOLUTION ACCEPTING AND APPROVING A TEMPORARY EASEMENT ON REAL PROPERTY. WHEREAS, The City of Waterloo, Iowa, has had the parcels described herein appraised and the fair market value ascertained, AND WHEREAS, the acquisition of a Temporary Easement hereinafter described is necessary to carry out the Kimball Avenue (South) Reconstruction Project in connection with the Interstate Substitution Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that the contract for the parcels hereinafter described, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement for the Temporary Easement from the owners thereof, and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sales from City Funds. The subject parcels are: PARCEL NO. 2B TEMPORARY GRADING EASEMENT A part of the NE 1/4 of Section 21-88-13, Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the SE corner of said NE 1/4; thence N 00°08'51" W along the East line of said NE 1/4 a distance of 679.71 feet; thence N 89°56'51" W a distance of 33.00 feet to the West R-O-W line of Kimball Avenue and the point of beginning; thence S 00°08'51" E along said R-O-W line a distance of 80.00 feet; thence N 89°56'51" W a distance of 17.00; thence N 00°08'51" W a distance of 80.00 feet; thence S 89°56'51" E a distance of 17.00 feet to the point of beginning. The East line of the NE 1/4 of Section 21-88-13 is assumed to bear N 00°08'51" W. Containing approximately 1360 sq. ft.
