HomeMy WebLinkAbout1986-424-07.14.1986 RESOLUTION NO. 1986-424 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEEDS. WHEREAS, The City of Waterloo, Iowa, has had all the parcels described herein appraised and the fair market value ascertained, AND WHEREAS, the acquisition of the hereinafter described parcels is necessary to carry out the Kimball Avenue (South) Reconstruction Project in connection with the Interstate Substitution Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that the contract for the parcels hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the properties from the owners thereof, and the deeds for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sales from City Funds. The subject parcels are: PARCEL NO. 2A RIGHT-OF-WAY ACQUISITION The East 10.00 feet of the West 55.00 feet of the NW 1/4 of Section 22-88-13, Waterloo, Black Hawk County, Iowa, excepting therefrom the North 388.50 feet and the South 75.00 feet. Containing approximately 8579 sq. ft. PARCEL NO. 2B RIGHT-OF-WAY ACQUISITION The West 22.00 feet of the East 55.00 feet of the South 400.00 feet of the NE 1/4 of Section 21-88-13, Waterloo, Black Hawk County, Iowa. Containing approximately 8800 sq. ft. PARCEL NO. 4A TEMPORARY GRADING EASEMENT A part of the SE 1/4 of the NE 1/4 of Section 21-88-13, Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the SE corner of said NE 1/4; thence N 00°08'51" W along the East line of said NE 1/4 a distance of 854.71 feet; thence N 89°56'51" W a distance of 33.00 feet to the West R-O-W line of Kimball Avenue and the point of beginning; thence N. 89°56'51" W a distance of 22.00 feet; thence N 00°08'51" W a distance of 133.84 feet to the South line of the North 332.00 feet of said SE 1/4, NE 1/4; thence N 89°05'51" E along said South line a distance of 22.00 feet to said West R-O-W line; thence S 00 08'51" E along said West R-O-W line a distance of 134.21 feet to the point of beginning.
