RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION
CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING
AND APPROVING CERTAIN DEEDS.
WHEREAS, The City of Waterloo, Iowa, has had all the parcels
described herein appraised and the fair market value ascertained,
AND WHEREAS, the acquisition of the hereinafter described parcels
is necessary to carry out the Kimball Avenue (South) Reconstruction
Project in connection with the Interstate Substitution Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Waterloo, Iowa, that the contract for the parcels hereinafter described
to sell the same to the City of Waterloo, Iowa, all of which are
situated in the City of Waterloo, Black Hawk County, Iowa, are directed
and approved and the Mayor Pro-Tem and the Deputy City Clerk are
authorized and directed to execute the same in behalf of the City and
to execute all instruments necessary to consummate the agreement to
purchase the properties from the owners thereof, and the deeds for the
conveyance of the same are also accepted and approved and the City of
Waterloo is directed to pay for the properties and the incidental
expenses necessary to the consummation of the sales from City Funds.
The subject parcels are:
R-O-W Acquisition (Parcel No. 36) :
A part of the NE 1/4 of Section 16-88-13, Waterloo, Black Hawk,
County, Iowa, described as follows;
Commencing at the SE corner of said NE 1/4; thence S.89°01 '08"W.
along the South line of said NE 1/4 a distance of 33.00 feet
to the point of beginning; thence S.89°01 '08"W. along said South
line a distance of 27.00 feet; thence N.00°09'33°" W. parallel with
the East line of said NE 1/4 a distance of 353.00 feet; thence
N.89°50'27" E. a distance of 10.00 feet; thence N.00°09'33"W.
parallel with the East line of said NE 1/4 a distance of 52.00
feet; thence N.89°50'27"E. a distance of 10.00 feet; thence
N.00°09 '33"W. parallel with the East line of said NE 1/4 a
distance of 219.00 feet; thence S.89°50'27"W. a distance of 10.00
feet: thence N.00°09 '33"W. parallel with the East line of said
NE 1/4 a distance of 618.00 feet; thence N.89°50'27"E. a distance
of 10.00 feet to the West R-O-W line of Kimball Avenue; thence
S.00°09'33"E. along said R-O-W line a distance of 491.80 feet;
thence N.89°00'00"E. along said R-O-W line a distance of 7.00
feet; thence S.00°09'33"E. along said R-O-W line a distance of
749.92 feet to the point of beginning.
The East line of the NE 1/4 of Section 16-88-13 is assumed to bear
N.00°09'33"W.
And also,
The West 15.00 feet of the East 55.00 feet of the North 1014.00
feet of the NE 1/4 of Section 16-88-13, Waterloo, Black Hawk
County, Iowa.
Containing approximately 34,216 sq. ft.
R-0-W Acquisition (Parcel No. 37) :

feet of the NW 1/4, and also, the East 15.00 feet of the West
55.00 feet of the South 580.00 feet of the North three-fourths of
the NW 1/4, all in Section 15-88-13, Waterloo, Black Hawk County,
