RESOLUTION ACCEPTING AND APPROVING CERTAIN
ACQUISITION CONTRACTS TO SELL REAL PROPERTY
TO THE CITY AND ACCEPTING AND APPROVING
CERTAIN DEEDS AND EASEMENTS.
WHEREAS, The City of Waterloo, Iowa, has had all the parcels
described herein appraised and the fair market value ascertained, and
WHEREAS, the Acquisition of the hereinafter described parcels
is necessary to carry out the Kimball Avenue Reconstruction Project in
connection with the Interstate Substitution Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Waterloo, Iowa, that Contract for the parcels hereinafter described
to sell the same to the City of Waterloo, Iowa, all of which are
situated in the City of Waterloo, Black Hawk County, Iowa, are accepted
and approved and the Mayor and City Clerk are authorized and directed to
execute the same in behalf of the City and to execute all instruments
necessary to consummate the agreement to purchase the property from the
owner thereof, and the deed for the conveyance of the same are also
accepted and approved and the City of Waterloo is directed to pay for
the property and the incidental expenses necessary to the consummation
of the sale from City Funds.
The subject parcels are:
PARCEL NO. 47
PERMANENT RIGHT-OF-WAY
A parcel of land located in the NW 1/4 of Section
10-88-13, Waterloo, Black Hawk County, Iowa, described
as follows:
Commencing at the NW corner of said NW 1/4; thence S.
00° 28' 05" E. along the West line of said NW 1/4 a
distance of 40.00 feet to the point of beginning:
thence N. 89° 31 ' 55" E. a distance of 20.00 feet;
thence S. 00° 28' 05" E. a distance of 465.27 feet:
thence S. 89° 09' 25" W. a distance of 20.00 feet;
thence N. 00° 28' 05" W. a distance of 465.40 feet to
the point of beginning.
The West line of the NW 1/4, Section 10-88-13 is
assumed to bear N. 00° 28' 05" W.
Containing approximately 9,307 sq. ft.
PARCEL NO. 47A
R-O-W ACQUISITION
The East 15.00 feet of the West 65.00 feet of the South
60.00 feet of the NW 1/4 of Section 10-88-13, Waterloo,
Black Hawk County, Iowa.
Containing approximately 900 sq. ft.

North 835.00 feet of said SW 1/4.
and also, the East 7.00 feet of the West 40.00 feet of
said SW 1/4, excepting therefrom the North 935.30 feet
and the South 1419.80 feet;
and also, the East 35.00 feet of the West 75.00 feet
of the North 217.00 feet of the South 257.00 feet of
said SW 1/4;
and also, the North 35.00 feet of the South 75.00 feet
of the East 125.00 feet of the West 200.00 feet of
said SW 1/4.
Containing approximately 22,400 sq. ft.

R-O-W ACQUISITION
The East 20.00 feet of the West 65.00 feet of the S

Containing approximately 13,230 sq. ft.
