I have personal knowledge of the matters set forth in this affidavit. 2. On or about October 2, 2023, the city council of the City of Waterloo approved a certain Development Agreement ("DA") and Minimum Assessment Agreement ("MAA") with JSA Development, LLC, concerning the development of property described therein, located at 425 Franklin Street, Waterloo, Iowa. 3. The DA and MAA contained a scrivener's error. The urbarr renewal area in which the property is located is the East Waterloo Unified Urban Renewal and Redevelopment Plan Area, not the Downtown Waterloo Urban Renewal and Redevelopment Plan Area. 4. RESOLUTION NO. 2024-604 RESOLUTION APPROVING A DEVELOPMENT AGREEMENT WITH A.C.O. CONSTRUCTION, L.C. FOR THE CONSTRUCTION OF TWO SINGLE-FAMILY DWELLINGS LOCATED AT 4429 AND 4455 CHARM DRIVE, INCLUDING A $5,000.00 INFILL INCENTIVE FOR EACH DWELLING FOR A TOTAL INCENTIVE AMOUNT OF $10,000.00, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT. WHEREAS, the City of Waterloo is committed to encouraging residential development and enhancing community infrastructure through strategic incentives, targeting infill development to optimally utilize existing urban spaces;and WHEREAS, A.C.O. Construction, L.C., has proposed the construction of two single-family dwellings at 4429 and 4455 Charm Drive, projects that align with the city's goals for local development and neighborhood improvement; and WHEREAS, a Development Agreement has been prepared to formalize terms of collaboration between the City of Waterloo and A.C.O. Construction, L.C., including a 5,000.00 infill incentive per dwelling, aggregating total incentive of 10,000.00, offered to stimulate quality housing development within the target area; and WHEREAS, this development partnership is anticipated to foster city growth, enhance property values, and serve the housing needs of current and future residents effectively. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo as follows: 1. The Development Agreement with A.C.O. Construction, L.C. is hereby approved to facilitate the construction of two single-family dwellings at specified locations on Charm Drive, furthering the city's residential growth strategy. 2. An infill incentive of 5,000.00 per dwelling, totaling $10,000.00, is authorized, as stipulated within the agreement, to support and incentivize construction in infill areas. 3. The Mayor and City Clerk are authorized and directed to execute the agreement and any supporting documents necessary to enact the provisions of this initiative. 4. The Planning and Zoning Department shall monitor the development progress to ensure compliance with the agreement terms and alignment with community objectives, providing updates to the council as appropriate. 5.
