RESOLUTION AUTHORIZING AMENDMENT TO CONDITION
NO. 7 OF ORDINANCE NO. 3428, AN ORDINANCE AMEND-
ING ORDINANCE NO. 2479, AS AMENDED BY ADDING SUB-
SECTION NO. 8 TO SECTION 2A-7-N, CONDITIONAL
ZONING FOR PROPERTY GENERALLY LOCATED WEST OF
ALEXANDRA DRIVE AND NORTH OF MURPHY ROAD EXTENDED.
WHEREAS, Ordinance No. 3428, an Ordinance amending Ordinance No.
2479, as amended by adding Sub-section No. 8 to Section 2A-7-N,
Conditional Zoning was adopted by the Waterloo City Council on April
7, 1986, and
WHEREAS, said Ordinance allowed Allied Construction Co. , Inc. , the
use of property generally located west of Alexandra Drive and north
of Murphy Road extended for a concrete batch plant, and
WHEREAS, ten (10) conditions were adopted by the Council in conjunc-
tion with said rezoning, and
WHEREAS, Condition No. 7 stipulated thatsaid site could be used only
in conjunction with the San Marnan Reconstruction Project and through
date of December 31, 1986, and
WHEREAS, Allied Construction Co. , Inc. , has requested that said site
be used for the Kimball Avenue North Project with removal of all
equipment utilized for said projects by December 31, 1986, and
WHEREAS, the Planning, Programming, and Zoning Commission has
recommended that said request be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA, that Ordinance No. 3428, Condition No. 7, be and the
same hereby amended to allow Allied Construction Co. , Inc., to use
said site for the Kimball Avenue North Project, with all equipment
removed by December 31, 1986.
Passed and adopted this 18th day of August, 1986.
