RESOLUTION RESCINDING RESOLUTION NO. 1986-255
ADOPTED BY THE WATERLOO CITY COUNCIL ON MAY 12,
1986, AUTHORIZING SALE AND CONVEYANCE OF PROPERTY
TO DAVID J. HERSHBERGER.
~WHEREAS, the Waterloo City Council held a public hearing on May 12,
1:1986, to sell and convey
property to David J. Hershberger legally
£-.described as follows:
Beginning at the point of intersection of the northerly line of
m - vacated Easton Avenue with the easterly line of I-380, thence
N89°13'30"E along the northerly line of vacated Easton Avenue
527.86', thence N21°18'49"W 228.3 ' along a line 100 feet
southwesterly of and parallel with the Iowa Northern Railroad,
s thence westerly parallel to the northerly line of vacated Easton
Avenue a distance of 531.64' to the easterly line of I-380, thence
o S19°13'29"W 178.4 ' along said easterly line, thence 532°22'10"W
.� �- 5232 feet to point of
p beginning. Also,
so, that portion of the 66 foot
right-of-way of vacated Easton Avenue lying east of I-380 and
;• :. westerly of a line 100 foot southwesterly of and parallel to the
westerly line of Iowa Northern Railway. The above described
G^ 2 property is subject to a Sanitary Sewer Easement described as
follows:
c Commenci ng at the point of intersection of the northerly line
of vacated Easton Avenue and the easterly line of I-380, thence
N89°13'30"E 341.53 feet to the point of beginning, thence
11S21°10'E to the centerline of vacated Easton Avenue, thence
south perpendicular to the right-of-way of vacated Easton
Avenue 33 feet to the south line of vacated Easton
Avenue, thence N89°13'30"E 43.17 ' , along said line, thence
north perpendicular to the last described course 33' to the
centerline of vacated Easton Avenue, thence N21°10 'W to the
north line of vacated Easton Avenue, thence continuing on the
last described course a distance of 228.3 feet, thence
S89°13'30"W 43.17 feet, thence S21°1O'E to the point of begin-
ning.
Also a public utility easement described as follows: The
Northerly 20 feet of vacated Easton Avenue lying easterly of
I-380 and westerly of a line 100 feet westerly of and parallel
to the westerly line of the Iowa Northern Railroad at a cost of
$50,000, plus costs.
WHEREAS, no objections were heard, and
WHEREAS, Resolution No. 1986-255 authorized the sale and conveyance
of said property to David J. Hershberger, and
WHEREAS, David J. Hershberger no longer desires said property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA, that Resolution No. 1986-255 be and the same hereby
rescinded.
Passed and adopted this 2nd day of September, 1986.
