RESOLUTION ACCEPTING AND APPROVING A PERMANENT
FLOWAGE EASEMENT ON REAL PROPERTY.
WHEREAS, The City of Waterloo, Iowa, has had the parcel
described herein appraised and the fair market value ascertained,

AND WHEREAS, the acquisition of a permanent flowage easement
herein after described is necessary to carry out the Kimball Avenue

Project in connection with the Interstate Substitution Plan.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City

= of Waterloo, Iowa, that the contract for the parcel hereinafter
described, all of which is situated in the City of Waterloo, Black
Hawk County, Iowa, is accepted and approved and the Mayor and City
Clerk are authorized and directed to execute the same in behalf of
the City and to execute all intruments necessary to consummate the
ad
agreement for the temporary easement from the owners thereof, and the
co _ City of Waterloo is directed to pay for the properties and the
ti incidental expenses necessary to the consummation of the sales from
r City Funds.

PERMANENT FLOWAGE EASEMENT
That part of the Northeast Fractional Quarter (NE 1/4) of
Sprtinn Four (4) and the Northwest Fractional Quarter
(NW 1/4) of Section Three (3), all in Township No.
Eighty-eight (88), Range Thirteen (13) West of Fifth
Principal Meridian, in the City of Waterloo, Black Hawk
County, Iowa, described as follows:
Beginning at the Northwest corner of Lot No. 1, Southaven
Addition, Waterloo, Black Hawk County, Iowa; thence North
along the East R-O-W Line of Kimball Avenue as now
established, a distance of Two Hundred Sixty-six (266)
feet; thence Easterly parallel with the North Line of
said Southaven Addition, a distance of Twenty (20) feet;
thence Southerly parallel with said East R-O-W Line of
Kimball Avenue, a distance of Two Hundred Twenty-six
(226) Feet; thence Easterly parallel with the North line
of said Southaven Addition, a distance of Three Hundred
Sixty (360) Feet; thence Southerly parallel with said
East R-O-W Line of Kimball Avenue, a distance of Forty
(40) Feet to the North Line of said Southaven Addition;
thence Westerly along the North Line of said Southaven
Addition to the point of beginning.
Containing approximately 19,720 sq. ft.
Passed and adopted this 22nd day of September, 1986.
