RESOLUTION ACCEPTING AND APPROVING CERTAIN
ACQUISITION, PERMANENT EASEMENT, AND TEMPORARY
EASEMENT CONTRACTS TO SELL REAL PROPERTY TO
THE CITY AND ACCEPTING AND APPROVING CERTAIN
DEEDS AND EASEMENTS
WHEREAS, The City of Waterloo, Iowa, has had all the parcels
described herein appraised and the fair market value or damage value
ascertained, and

WHEREAS, the Acquisition of the hereinafter described parcels
Sis necessary to carry out the West Fourth Street Reconstruction Project
Fin connection with the Interstate Substitution Plan.

- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
7bf Waterloo, Iowa, that the Acquisition or Easement Contract for the
parcels hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which are situated in the City of Waterloo, Black Hawk
:County, Iowa, are accepted and approved and the Mayor and City Clerk are
authorized and directed to execute the same in behalf of the City and to
=execute all instruments necessary to consummate the agreement to
apurchase the properties from the owners thereof, and the deeds,
permanent easements, and temporary easements for the conveyance of the
same are also accepted and approved and the City of Waterloo is directed
to pay for the properties and the incidental expenses necessary to the
consummation of the sales from City Funds.
The subject parcels are:
PARCEL #40 - Partial Acquisition
That part of the Southeast Quarter (SE 1/4) of Section Thirty-three (33),
Township Eighty-nine North (T89N), Range Thirteen West (R13W) of the Fifth
Principal Meridian in the City of Waterloo, Black Hawk County, Iowa,
described as follows:
Beginning at a point on the Northwesterly line of West Fourth Street
which is Thirty-three (33.0) feet normally distant from the
centerline of said West Fourth Street and Seventy-three and
Twenty-five Hundredths (73.25) feet Southwesterly of the intersection
of said Northwesterly line and a line which begins on the centerline
of said West Fourth Street at a distance of One Thousand One Hundred
Eighty-three and Ninety-three Hundredths (1183.93) feet Northeasterly
of the South line of said Southeast Quarter (SE 1/4), said line if
extended, would intersect the North line of the Southeast Quarter
(SE 1/4) of the Southeast Quarter (SE 1/4) of said Section at a point
Thirty (30.0) feet East of the Northwest corner thereof; thence
continuing Southwesterly Seventy (70.0) feet along said Northwesterly
line of West Fourth Street; thence Northwest at right angles Thirty
(30.0) feet; thence Northeasterly parallel with said West Fourth
Street Seventy (70.0) feet; thence Southeasterly at right angles
Thirty (30.0) feet to the point of beginning.
Area 2100 S.F. more or less.
