RESOLUTION ACCEPTING AND APPROVING CERTAIN
ACQUISITION, PERMANENT EASEMENT, AND
TEMPORARY EASEMENT CONTRACTS TO SELL REAL
PROPERTY TO THE CITY AND ACCEPTING AND APPROVING
CERTAIN DEEDS AND EASEMENTS.
m m WHEREAS, The City of Waterloo, Iowa, has had all of the parcel
described herein appraised and the fair market value ascertained,

N�, r WHEREAS, the acquisition of the hereinafter described parcel
is necessary to carry out the Donald Street Reconstruction Project in
connection with the Interstate Substitution Plan.
f--- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Waterloo, Iowa, that the Acquisition or Easement Contract for the
- parcel hereinafter described to sell the same to the City of

0-., Waterloa; Iowa, all of which is situated in the City of Waterloo,
Black - lawk County, Iowa, is accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in behalf
of the City and to execute all instruments necessary to consummate
the agreement to purchase the properties from the owner thereof, and
the deeds, permanent easements, and temporary easements for the
conveyance of the same are also accepted and approved and the City of
Waterloo is directed to pay for the properties and the incidental
expenses necessary to the consummation of the sale from City Funds.
The subject parcel is;
PARCEL NO. 927 - Casper B. and Evelyn D. Schmitt:
Legal description:
The Northerly 15 feet in even width of the Southerly 48 feet
in even width of all that part of the Southeast Quarter of the
Southeast Quarter of Section No. 12, Township No. 89 North,
Range No. 13 West of the Fifth (5th) Principal Meridian in
Black Hawk County, Iowa, bounded and described as follows:
Commencing at a point on the South line of said Section that
is 350 feet East of the Southwest corner of the Southeast
Quarter of the Southeast Quarter of said Section; running
thence East along the South line of said Section a distance of
160 feet; thence North along a line that is parallel with the
East line of said Section a distance of 660 feet; thence West
along a line that is parallel with the South line of said
Section a distance of 160 feet; thence South along a line that
is parallel with the East line of said Section a distance of
660 feet to the point of beginning.
Containing approximately 2,400 sq. ft.
Passed and adopted this 9th day of February, 1987.
