HomeMy WebLinkAbout1987-089-03.09.1987 RESOLUTION NO. 1987-89 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION, PERMANENT EASEMENT, AND TEMPORARY EASEMENT CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEEDS AND EASEMENTS. WHEREAS, the City of Waterloo, Iowa, has had all of the parcel described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcel is necessary to carry out the Relocated U.S. 218 (IX-218-7(49)--3P-07) and U.S. 63 (IX-63-6(39)--3P-07) in connection with the Interstate Substitution Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that the Acquisition or Easement Contract for the parcel hereinafter described to sell the same to the City of Waterloo, Iowa, all of which is situated in the City of Waterloo, Black Hawk County, Iowa, is accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the properties from the owner thereof, and the deeds, permanent easements, and temporary easements for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sale from City funds. The subject parcels are: Parcel No. 123 - Warranty Deed A parcel of land consisting of that part of a Tract acquired by Warranty Deed from Cadillac Lanes, Inc. , as recorded in Book 535 L.D. , Page 232, in the office of the Black Hawk County Recorder, located in the SW 1/4 NE 1/4 of Sec. 36, T89N, R13W of the 5th P.M. , in the City of Waterloo, Black Hawk County, Iowa, described as lying northeasterly of a line beginning at a point 60 ft. south of the NE Corner of said Tract, on the east line thereof; thence northwesterly to a point 26 ft. west of the NE Corner of said Tract, on the north line thereof; containing 780 sq. ft. Parcel No. 123 - Corporate Warranty Deed A parcel of land consisting of that part of a Tract acquired by Warranty Deed from Cadillac Lanes, Inc. , as recorded in Book 535 L.D. , Page 232, in the office of the Black Hawk County Recorder, located in the SW 1/4 NE 1/4 of Sec. 36, T89N, R13W of the 5th P.M. , in the City of Waterloo, Black Hawk County, Iowa, described as lying northeasterly of a line beginning at a point 60 ft. south of the NE Corner of said Tract, on the east line thereof; thence northwesterly to a point 26 ft. west of the NE Corner of said Tract, on the north line thereof: containing 780 sq. ft. Parcel No. 132 - Corporate Warranty Deed A parcel of land located in the NE 1/4 SE 1/4 of Sec. 36, T89N, R13W of the 5th P.M. , in the City of Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the NW Corner of the NE 1/4 SE 1/4 of said Sec. 36; thence S90°001E, 384.3 ft. along the north line of said NE 1/4 SE 1/4; thence SO°00'E, 33.0 ft. to the NW Corner of the land described in a certain Warranty Deed recorded in Book 460, Pages 589 and 590 in the Office of the Black Hawk County Recorder, the Point of Beginning; thence SO°45 1/2 'E, 17.0 ft. along the west line of said land; thence N87°14 1/2'E, 208.1 ft. to a point on the westerly right of way line of the Chicago, Rock Island and Pacific Railroad Company; thence N20°45 1/2 'W, 7.5 ft. along said westerly line to the NE Corner of said land described in a certain Warranty Deed recorded in Book 460, Pages 589 and 590 in the Office of the Black Hawk County Recorder; thence S90°00'W, 205.4 ft. along the north line of said land to the Point of Beginning; containing 2487 sq. ft. , more or less.
