RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION,
PERMANENT EASEMENT, AND TEMPORARY EASEMENT CONTRACTS

WHEREAS, the City of Waterloo, Iowa, has had all of the parcels
cescribed herein appraised and the fair market value ascertained,

H ' 'WHEREAS, the acquisition of the hereinafter described parcels
necessary to carry out the Donald Street Reconstruction Project
` in connection with the Interstate Substitution Plan
(I;4662(2)--79-07) .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
'; OF WATERLOO, IOWA, that the Acquisition or Easement Contract for the
vi = parcels hereinafter described to sell the same to the City of
`I Waterloo, Iowa, all of which are situated in the City of Waterloo,
Black Hawk County, Iowa, are accepted and approved and the Mayor Pro
Tem and City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreements to purchase the properties from the owners
thereof, and the deeds, permanent easements, and temporary easements
for the conveyance of the same are also accepted and approved and the
'``-, City of Waterloo is directed to pay for the properties and the
"tilncidental expenses necessary to the consummation of the sale from
r='tity funds.
The subject parcel is:
Parcel No. 517 _ Partial Acquisition (Lutheran Church of God
All that part of the Southeast 1/4 of the Southwest 1/4 of
Section No. 12, Township No. 89 North, Range No. 13 West of the
5th P.M. in the City of Waterloo, Black Hawk County, Iowa,
described as follows :
Beginning at a point which is 33 feet North and 33 feet East of
the Southwest corner of said Southeast 1/4; thence East along a
line which is parallel with the South line of said Section 12 a
distance of 480 feet to the Southwest corner of Lot No. 1,
Hollingsworth Addition; thence North along the West line of
said Lot No. 1 a distance of 4.65 feet; thence West to a point
that is 33 feet East of the West line of said Southeast 1/4 and
7 feet North of the point of beginning; thence South to the
point of beginning.
Containing approximately 2,796 sq. ft.
Parcel No. 517 - Temporary Easement (Lutheran Church of God
The Southerly 14 feet in even width of the following described
parcel of land:
Beginning at a point which Thirty-three (33) feet North and
Thirty-three (33) feet East of the Southwest corner of the
Southeast Quarter (SE 1/4) of the Southwest Quarter (SW 1/4) of
Section No. Twelve (12), Township No. Eighty-nine (89) North,
Range No. Thirteen (13) West of the 5th P.M. in Black Hawk
County, Iowa; thence East along a line which is parallel with
the South line of said Section No. Twelve (12) a distance of
Four Hundred Eighty (480) feet; thence North along a line which
is parallel with the West line of said Section No. Twelve (12)
a distance of Two Hundred Forty (240) feet; thence West along a
line that is parallel with the South line of said Section No.
Twelve (12) a distance of Four Hundred Eighty (480) feet;
thence South to the point of beginning.
Excepting therefrom the above-described permanent right of
way.

Parcel No. 609 - Partial Acquisition (George Meeks)
All that part of Lot No. Two (2) in Hollingsworth Addition
described as follows :
Beginning at the Southwest corner of said Lot No. Two (2) ;
thence East along the South line of said Lot No. Two (2) to the
Southeast corner of said Lot No. Two (2); thence North along
the East line of said Lot No. Two (2) a distance of 4.06 feet;
thence West to a point on the West line of said Lot No. Two
(2), which point is 4.36 feet North of the Southwest corner of
said Lot No. Two (2) ; thence South along the West line of said
Lot No. Two (2) to the point of beginning.
Containing approximately 252.6 sq. ft.
Parcel No. 609 - Temporary Easement (George Meeks)
The South 25 feet in even width of the West 20 feet in even

described as follows:
Beginning at the Southwest corner of said Lot No. Three (3) ;
thence East along the South line of said Lot No. Three (3) to
the Southeast corner of said Lot No. Three (3): thence North
along the East line of said Lot No. Three (3) a distance of
3.77 feet; thence West to a point on the West line of said Lot
No. Three (3), which point is 4.06 feet North of the Southwest
corner of said Lot No. Three (3) ; thence South along the West
line of said Lot No. Three (3) to the point of beginning.

thence East along the South line of said Lot No. Five (5) to
the Southeast corner of said Lot No. Five (5) ; thence North
along the East line of said Lot No. Five (5) a distance of 3.17
feet; thence West to a point on the West line of said Lot No.
Five (5), which point is 3.47 feet North of the Southwest
corner of said Lot No. Five (5); thence South along the West
line of said Lot No. Five (5) to the point of beginning.
Containing approximately 199.2 sq. ft.
Parcel No. 621 - Partial Acquisition (Earl Varco)

described as follows:
