RESOLUTION NO. 1987-125 RESOLUTION AUTHORIZING THE CONDEMNATION OF CERTAIN PARCELS OF REAL PROPERTY FOR THE WAGNER ROAD BRIDGE RECONSTRUCTION PROJECT. WHEREAS, the City of Waterloo, Iowa has undertaken the Wagner Road Bridge Reconstruction Project and the parcels of land hereinafter described have been appraised and offers made to the owner of said property in the amount of the appraised value and said offers have been refused; and WHEREAS, the acquisition, by either Fee Simply Title or Temporary Easement of the hereinafter described real property is necessary in connection with the said Wagner Road Bridge Reconstruction Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the following described parcels of real property be acquired by condemnation in the manner provided by law, and such other further action as may be necessary to effect acquisition: Parcel No. 1 - Partial Acquisition (Esther Brinker, et al ) That part of the Southeast Quarter (SE 1/4) of Section Nine (90), Township Eighty-nine North (T89N), Range Thirteen West (R13W) of the Fifth Principal Meridian in the City of Waterloo, Black Hawk County, Iowa, described as follows : Beginning at a point on the North line of said Southeast Quarter (SE 1/4) which is Thirty-three (33.0) feet West of the Northeast corner of said Southeast Quarter (SE 1/4), said point also lying on the existing West line of Wagner Road; thence South along said West line of Wagner Road to the South line of the creek as described in Deeds Book 522 Page 393; thence Southwesterly along said creek to a point which is One Hundred Twenty (120.0) feet West of the East line of said Southeast Quarter (SE 1/4) ; thence South parallel with said East line of Southeast Quarter (SE 1/4) to the South line of the Northeast Quarter (NE 1/4) of said Southeast Quarter (SE 1/4); thence West along said South line Eighty (80.0) feet; thence North parallel with said East line of Southeast Quarter (SE 1/4) to a point which is Seven Hundred Ninety-five (795.0) feet South of the Northeast corner of said Southeast Quarter (SE 1/4); thence Northeasterly Two Hundred Five and Nine Tenths (205.9) feet to a point which is One Hundred (100) feet West and Six Hundred Fifteen (615.0) feet South of the Northeast corner of said Southeast Quarter (SE 1/4) ; thence North parallel with said East line of Southeast Quarter (SE 1/4) Ninety-five (95.0) feet; thence Northeasterly One Hundred Seventy-seven and Two Tenths (177.2) feet to a point which is Fifty (50.0) feet West and Three Hundred Fifty (350.0) feet South of the Northeast corner of said Southeast Quarter (SE 1/4) ; thence North parallel with said East line of Southeast Quarter (SE 1/4) Three Hundred Fifty and Six Tenths (350.6) feet to the North line of said Southeast Quarter (SE 1/4); thence East Seventeen (17.0) feet to the point of beginning . RESOLUTION NO. 1987-125 Page Two Parcel No. 1 - Temporary Easement (Esther Brinker, et al ) That part of the Southeast Quarter (SE 1/4) of Section Nine (9), Township Eighty-nine North (T89N) , Range Thirteen West (R13W) of the Fifth Principal Meridian in the City of Waterloo, Black Hawk County, Iowa, described as follows : Beginning at a point which is Five Hundred Twenty (520) feet South and One Hundred (100) feet West of the Northeast corner of said Southeast Quarter (SE 1/4) ; thence Southwesterly to a point which is Six Hundred Forty-five (645) feet South and Two Hundred (200) feet West of said Northeast corner; thence Southwesterly to a point which is Nine Hundred Fifty (950) feet South and Three Hundred Ten (310) feet West of said Northeast corner; thence Southeasterly to a point which is One Thousand One Hundred Seventy (1170) feet South and Two Hundred (200) feet West of said Northeast corner; thence North parallel with the East line of said Southeast Quarter (SE 1/4) Three Hundred Seventy-five (375) feet; thence Northeasterly Two Hundred Five and Nine Tenths (205.9) feet to a point which is Six Hundred Fifteen (615) feet South and One Hundred (100) feet West of said Northeast corner; thence North Ninety-five (95) feet to the point of beginning. Huff) That part of the Southwest Quarter (SW 1/4) of Section Ten (10), Township Eighty-nine North (T89N), Range Thirteen West (R13W) of the Fifth Principal Meridian in the City of Waterloo, Black Hawk County, Iowa, described as follows: The East Twenty-two (22.0) feet of the West Fifty-five (55.0) feet of the North Two Hundred (200.0) feet of said Southwest Quarter (SW 1/4) of Section Ten (10). Parcel No. 3 - Partial Acquisition (Lois Davenport, et al ) The West Twenty-two (22.0) feet in even width of that part of the Southwest Quarter (SW 1/4) of Section Ten (10), Township Eighty-nine North (T89N) , Range Thirteen West (R13W) of the Fifth Principal Meridian in the City of Waterloo, Black Hawk County, Iowa, as recorded in Land Deed Book 545, page 998, to-wit: That part of the Southwest Quarter of Section No. 10 in Township No. 89 North, Range No. 13 West of the 5th Principal Meridian in the City of Waterloo, Black Hawk County, Iowa, described as follows: Commencing at a point on the North line of said Southwest Quarter which is 33 feet East of the Northwest corner of said Southwest Quarter; thence East along said North line 272.48 feet to the Southwesterly line of U.S. Highway No. 20 as established by deed recorded in Deed Record 500, page 692 of the records of Black Hawk County, Iowa; thence Southeasterly along said Southwesterly line 190 feet; thence Southwesterly to a point on the East line of Wagner Road which is 562.4 feet South of the point of beginning; thence North along said East line to the point of beginning, except the North 200 feet thereof.
