RESOLUTION NO. 1987-164 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION PERMANENT EASEMENT AND TEMPORARY EASEMENT CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEEDS AND EASEMENTS (DONALD STREET RECONSTRUCTION IX-6662(2)--79-07). WHEREAS, The City of Waterloo, Iowa, has had all of the parcels described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcels are necessary to carry out the Donald Street Reconstruction Project in connection with the Interstate Substitution Plan (Donald Street Reconstruction IX-6662(2)--79-07). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo, Iowa, that the Acquisition of Easement Contract for the parcels which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the properties from the owners thereof, and the deeds, permanent easements, and temporary easements for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidential expenses necessary to the consummation of the sale frcm City Funds. The subject parcels are: PARCEL NO. 607 - 607 East Donald Street - Dennis J. and Diane M. Ernster (Permanent Right-of-Way) . All that part of Lot No. One (1) in Hollingsworth Addition, Waterloo, Iowa, described as follows: Beginning at the Southwest Corner of said Lot No. One (1) ; thence East along the South line of said Lot No. One (1) to the Southeast Corner of said Lot No. One (1) ; thence North along the East line of said Lot No. One (1) a di stance of 4.36 feet; thence West to a point on the West line of said Lot No. One (1), which point is 4.65 feet North of the Southwest Corner of said Lot No. One (1) ; thence South along the West line of said Lot No. One (1) to the point of beginning . (Containing approximately 270.3 sq. ft.) PARCEL NO. 607 - 607 East Donald Street - Dennis J. and Diane M. Ernster (Temporary Easement) . The South 30 feet in even width of the West 20 feet in even width of Lot No. One (1) in Hollingsworth Addition, Waterloo, Iowa. Excepting therefrom the above-described permanent right-of-way. (Containing approximately 508 sq. ft. ) PARCEL NO. 901 - 901 East Donald Street - Tressa V. Bige (Partial Acquisition). All that part of the East Ten acres of the Southwest 1/4 of the Southeast 1/4 of Section 12, Township 89 North, Range 13 West of the Fifth Principal Meridian, Waterloo, Black Hawk County, Iowa, described as follows: Beginning at a point on the East line of the Southwest 1/4 of the Southeast 1/4 of said Section 12, which point is 39 feet North of the Southeast Corner of the Southwest 1/4 of the Southeast 1/4 of said Section 12; thence South along the East line of the Southwest 1/4 of the Southeast 1/4 of said Section 12 a distance of 6 feet; thence West parallel with the South line of the Southeast 1/4 of said Section 12 to the West line of said East ten acres; thence North along the West line of said East ten acres a di stance of 45.7 feet; thence Southeasterly to a point wh ich is 100 feet normally distant East of the West line of said East ten acres and 66.1 feet normally distant North of the South line of the Southeast 1/4 of said Section 12; thence Southeasterly to a point RESOLUTION NO. 1987-164 Page Two which is 190 feet normally distant East of the West line of said East ten acres and 40.3 feet normally distant North of the South line of the Southeast 1/4 of said Section 12; thence Southeasterly to the point of beginning.
