HomeMy WebLinkAbout1987-204-05.04.1987 RESOLUTION NO. 1987-204 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CERTAIN EXCESS REAL PROPERTY TO DAVID J. HERSHBERGER FOR $49 , 900, PLUS COSTS AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND DELIVER A DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcel of real property in the sum of $49, 900 , plus costs , has been made by David J. Hershberger, and WHEREAS, a public hearing was held on May 4 , 1987 at 7 : 00 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey premises owned by the City of Waterloo, Iowa to David J. Hershberger, Waterloo, Iowa, and NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1 . The following described real property, as fully de- scribed in the published notice in the Waterloo Courier on April 28 , 1987 , is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of David J. Hershberger to purchase real property for the sum of $49 , 900 and costs be, and it is hereby accepted for real property described below: A parcel of land located in the Southeast Quarter of Section 36 , Township 89 , Range 13 in the City of Waterloo, Black Hawk County, Iowa, described as follows: Beginning at the point of intersection of the northerly line of vacated Easton Avenue with the easterly line of I-380 , thence N89°13 ' 30"E along the northerly line of vacated Easton Avenue 527 . 86 ' thence N21°18 ' 49"W 228 . 3 ' along a line 100 feet southwesterly of and parallel with the Iowa Northern Railroad, thence westerly parallel to the northerly line of vacated Easton Avenue a distance of 531 . 64 ' to the easterly line of I-380 , thence S19°13 ' 29"W 178 . 4 ' along said easterly line, thence S32°22 ' 10"W 52 . 32 feet to point of beginning. Also, that portion of the 66 foot right-of-way of vacated Easton Avenue lying east of I-380 and westerly of a line 100 foot southwesterly of and parallel to the westerly line of Iowa Northern Railway. The above described property is subject to a Sanitary Sewer Easement described as follows: Commencing at the point of intersection of the northerly line of vacated Easton Avenue and the easterly line of I-380, thence N89°13 ' 30"E 341 . 53 feet to the point of beginning, thence S21°10 ' E to the centerline of vacated Easton Avenue thence south perpendicular to the right-of-way of vacated Easton Avenue 33 feet to the south line of vacated Easton Avenue, thence N89°13 ' 30"E 43 . 17 feet, along said line, thence north perpendicular to the last described course 33 ' to the centerline of vacated Easton Avenue, thence N21°10 'W to the north line of vacated Easton Avenue, thence continuing on the last described course a distance of 228 . 3 feet, thence S89°13 ' 30"W 43 . 17 feet, thence S21°10 ' E to the point of beginning. Resolution No. 1987-204 Page 2 Also, a public utility easement described as follows : The Northerly 20 feet of vacated Easton Avenue lying easterly of I-380 and westerly of a line 100 feet westerly of and parallel to the westerly line of the Iowa Northern Railroad. 3 . That the City of Waterloo, Iowa, convey said parcels of real property to David J. Hershberger by Quit Claim Deed, the form of which is hereto attached and approved. 4. That the Mayor and City Clerk are hereby authorized to execute and deliver deed to David J. Hershberger. 5 . That the original of said deed fully executed and acknowledged having been submitted with this Resolution, the same is hereby approved and confirmed by the Council. 6. That the City Clerk is authorized and directed to deliver said deed of conveyance to David J. Hershberger upon receipt of the sum of $49, 900 and costs. PASSED AND ADOPTED this 4th day of May, 1987.
