RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION
CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND
ACCEPTING AND APPROVING CERTAIN DEED.
WHEREAS, the City of Waterloo, Iowa, has had the parcel
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcel
is necessary to carry out the FY 1987 W.C.F. & N. Drive Paving
Project, Contract No. 297 in connection with the RISE Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcel
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which is situated in the City of Waterloo, Black Hawk
County, Iowa, is accepted and approved and the Mayor and City
Clerk are authorized and directed to execute the same in behalf of
the City and to execute all instruments necessary to consummate
the agreement to purchase the property from the owner thereof, and
the deeds for the conveyance of the same are also accepted and
approved and the City of Waterloo is directed to pay for the
property and the incidental expenses necessary to the consummation
of the sale from City funds.
The subject parcel is:

That part of the Southwest Quarter (SW 1/4 ) of Section Ten
( 10) , Township Eighty-nine North (T89N) , Range Thirteen West
(R13W) of the Fifth Principal Meridian, City of Waterloo,
Black Hawk County, Iowa, described as follows:
Beginning at a point on the North line of said Southwest
Quarter (SW 1/4 ) which is Five Hundred Twenty-five ( 525 . 0 )
feet West of the Northeast corner of said Southwest Quarter
(SW 1/4 ) ; thence S48°04 'W Seven Hundred Sixty-six and One
Tenth ( 766 . 10 ) feet to a point on the Northeast right of way
line of the Chicago, Central and Pacific Railroad which is
Seven Hundred Fifty-five ( 755 . 0 ) feet Southeasterly of the
North line of said Southwest Quarter (SW 1/4 ) as measured
along said Northeast right of way line; thence Southeasterly
along said right of way line Thirty-five and Two Tenths
( 35. 20) feet; thence N48°04 'E Six Hundred Twenty-eight and
Fifty-six Hundredths ( 628 . 56 ) feet to a point which is One
Hundred Fifteen ( 115. 0) feet South of the North line of said
Southwest Quarter (SW 1/4 ) ; thence East parallel with said
North line Five Hundred Seventy-six and Fifteen Hundredths
( 576 . 15 ) feet to the West line of the East Twenty-five ( 25. 0 )
feet of said Southwest Quarter (SW 1/4 ) ; thence North Thirty
( 30 . 0) feet along said West line; thence West parallel with
the North line of said Southwest Quarter (SW 1/4) Two Hundred
Ninety-five ( 295 . 0 ) feet; thence North parallel with the East
line of said Southwest Quarter (SW 1/4 ) Eighty-five ( 85 . 0 )
