WHEREAS, the Board of Park Commissioners of the City of Waterloo did convey real property to Chamberlain Manufacturing on or about the 29th day of June, 1946, and WHEREAS, it was the intent of the Board of Park Commissioners to convey to Chamberlain Corporation the following legally described property: Beginning in a point on the south line of Block 16 in Enterprise Place in the City of Waterloo, Iowa, which is 265 feet east of the southwest corner of said Block 16 ; thence east along the south line of said Block 16 a distance of 135 feet; thence south along a line parallel with the west line of said Block 16 to the northerly line of the right of way of the Waterloo, Cedar Falls and Northern Railroad; thence northwesterly along the northerly line of said right of way to an intersection with a line parallel with and 265 feet east of the west line of said Block 16 ; thence north to the place of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Quit Claim Deed conveying real property to Chamberlain Manufacturing Corporation in Enterprise Place, be and the same hereby approved. BE IT FURTHER RESOLVED that the Deputy Clerk/Auditor be and the same hereby instructed to record said Quit Claim Deed. That I have examined the relevant documents and herein state that said documents reflect the intent of the Board of Park Commissioners to have conveyed, to the Chamberlain Corporation, the real estate legally described as: Beginning at a point on the South line of Block 16 in Enter- prise Place in the City of Waterloo, Iowa, which is 265 feet East of the Southwest corner of said Block 16 ; thence East along the South line of said Block 16 a distance of 135 feet ; thence South along a line parallel with the West line of said Block 16 to the Northerly line of the right-of-way of the Waterloo, Cedar Falls and Northern Railroad; thence Northwesterly along the Northerly line of said right-of-way to its intersection with a line parallel with and 265 feet East of the West line of said Block 16 ; thence North to the place of beginning. That , furthermore, I have read the Minutes of the Meetings of the City Council of the City of Waterloo, wherein the Council did- approve the above-mentioned conveyance and that , through inadvertence, the above-described real estate was not properly conveyed to the Chamberlain Corporation.
