RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF
PARCEL A TO WAYNE AND ANICETA CLAASSEN FOR $5 , 800. 00
PLUS COSTS, PARCEL B TO WAYNE AND ANICETA CLAASSEN FOR
$5, 600. 00 PLUS COSTS AND PARCEL C TO WILLIAM AND DOROTHY
MILLER FOR $5, 465. 00 PLUS COSTS AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AND DELIVER DEEDS FOR
SAME.
WHEREAS, the City of Waterloo, Iowa, is the owner of real
property in the City of Waterloo, Iowa, as described below, and
WHEREAS, an offer to purchase said certain parcel of real
property known as Parcel A in the sum of $5,800. 00 , plus costs,
has been made by Wayne and Aniceta Claassen, and
WHEREAS, an offer to purchase said certain parcel of real
property known as Parcel B in the sum of $5, 600. 00, plus costs,
has been made by Wayne and Aniceta Claassen, and
WHEREAS, an offer to purchase said certain parcel of real
property known as Parcel C in the sum of $5 , 465 . 00, plus costs,
has been made by William and Dorothy Miller, and
WHEREAS, a public hearing was held on July 13 , 1987, at 7: 00
p.m. , in the Council Chambers in City Hall, Waterloo, Iowa, as
provided by law, by the Council of the City of Waterloo, Iowa, on
the proposal to sell and convey premises known as Parcel A owned
by the City of Waterloo, Iowa to Wayne and Aniceta Claassen;
Parcel B owned by the City of Waterloo, Iowa to Wayne and Aniceta
Claassen; and Parcel C owned by the City of Waterloo, Iowa to
William and Dorothy Miller, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1. The following described real property, as fully
described in the published notice in the Waterloo Courier on June
26, 1987, is not presently needed and will not be needed in the
foreseeable future for municipal purposes and its ownership is
serving no municipal purpose, and,
2 . That the offer of Wayne and Aniceta Claassen to purchase
real property known as Parcel A for the sum of $5 , 800. 00 and
costs; the offer of Wayne and Aniceta Claassen to purchase real
property known as Parcel B for the sum of $5 , 600 . 00 and costs; and
the offer of William and Dorothy Miller to purchase real property
known as Parcel C for the sum of $5,465 . 00 and costs be, and it is
hereby accepted for real property described below:
Parcel A
All that part of Lots 1 and 2 , "Sunset View" and all that
part of Lot 1 in "Byrnbrae Second Addition" in the City of
Waterloo, Black Hawk County, Iowa, lying within the following
described boundary:
Beginning at the Southwesterly corner of Lot 1, "Sunset
View" ; thence North 1°10 ' 45" West along the West line of
"Sunset View" a distance of 135 . 00 feet; thence North
89°56 ' 55" East a distance of 235 . 77 feet; thence South
1°09 ' 46" East 77. 00 feet West of and parallel with the East

line of the Southeast 1/4 of Section 33 , Township 89 North,
Range 13 West of the Fifth Principal Meridian a distance of
276 . 55 feet; thence South 89°55 ' 34" West along the southerly
line of Lot 1, "Byrnbrae Second Addition" , a distance of
51. 25 feet to the southwesterly corner of Lot 1, "Byrnbrae
Second Addition" ; thence North 0°04 ' 26" West a distance of
141 . 56 feet to the northwesterly corner of Lot 1, "Byrnbrae
Second Addition" ; thence South 89°56 ' 55" West a distance of
187 . 17 feet to the point of beginning.
Containing approximately 38, 891 sq. ft.
Parcel B
All that part of Lots 2 and 3 , "Sunset View" , City of
Waterloo, Black Hawk County, Iowa, lying within the following
described boundary:
Beginning at a point on the West line of said "Sunset View" ,
which point is 135 . 00 feet north of the Southwest corner of
Lot 1, "Sunset View" ; thence N 1°10 ' 45" West along the West
line of said "Sunset View" a distance of 130 . 05 feet; thence
N 89°58 ' 31" East a distance of 235 . 81 feet to a point which
is 44. 00 feet normally distant west of the East line of said
Lot 3 ; thence S 1°09 ' 46" East along a line that is 44 . 00 feet
West of and parallel with the East line of said Lots 2 and 3
a distance of 129. 94 feet; thence S 89°56 ' 55" West a distance
of 235. 77 feet to the point of beginning.
Containing approximately 30, 645 . 5 sq. ft.
Parcel C
All that part of Lots 3 , 4 and 5 , "Sunset View" , City of
Waterloo, Iowa, Black Hawk County, Iowa, lying within the
following described boundary:
Beginning at a point on the West line of "Sunset View" , which
point is 265 . 05 feet North of the Southwest corner of said
"Sunset View" ; thence N 1°10 ' 45" West along the West line of
said "Sunset View" a distance of 135 . 00 feet to the Southwest
corner of said Lot 5 ; thence North 89°58 ' 30" East along the
South line of said Lot 5 a distance of 159 . 85 feet to the
Southeast corner of the parcel of land recorded in Book 563 ,
page 183 , in the Black Hawk County Recorder' s office; thence
N 1°09 ' 46" West along the East line of said parcel a distance
of 109. 13 feet to a point on the North line of said "Sunset
View" ; thence N 90° East along the North line of said "Sunset
View" a distance of 76 . 00 feet to a point which is 44. 00 feet
normally distance West of the East line of said Lot 5; thence
S 1°09 ' 46" East along a line that is 44 . 00 feet West of and
parallel with the East line of said Lots 3 , 4, and 5 a
distance of 244 . 10 feet; thence S 89°58 ' 31" West a distance
of 235 . 81 feet to the point of beginning.
Containing approximately 40 , 121 . 6 sq. ft.
3 . That the City of Waterloo, Iowa, convey said Parcel A of
real property to Wayne and Aniceta Claassen, Parcel B of real
property to Wayne and Aniceta Claassen and Parcel C of real
property to William and Dorothy Miller by Quit Claim Deed, the
form of which is hereto attached and approved.
4 . That the Mayor and City Clerk are hereby authorize: to
execute and deliver deeds to Wayne and Aniceta Claassen and
William and Dorothy Miller.

n 5. - That the original of said deeds fully executed and
acknowledged having been submitted with this Resolution, the same
is hereby approved and confirmed by the Council.
6 . That the City Clerk is authorized and directed to
deliver said deed of conveyance for Parcel A to Wayne and Aniceta
Claassen upon receipt of the sum of $5 , 800 . 00 and costs; Parcel B
to Wayne and Aniceta Claassen upon receipt of the sum of $5 , 600 . 00
and costs; and Parcel C to William and Dorothy Miller upon receipt
of the sum of $5 ,465 . 00 and costs.
