HomeMy WebLinkAbout1987-372-07.20.1987 (RECORDED) RESOLUTION NO. 1987-372 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEEDS. WHEREAS, the City of Waterloo, Iowa, has had all the parcels described herein appraised and the fair market value ascertained, and WHEREAS , the acquisition of the hereinafter described parcels is necessary to carry out the FY 1988 Independence Avenue Area Storm and Sanitary Sewer Improvements, Contract No. 329 , in connection with the Interstate Substitution Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcels hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the properties from the owners thereof , and the deeds for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sales from City funds . The subject parcels are: \x cel No. 1-Permanent Easement-Independent School District That part of the Northeast Quarter (NE 1/4 ) of Section Thirty ( 30 ) , Township Eighty-nine North (T89N) , Range Twelve West (R12W) of the Fifth Principal Meridian in the City of Waterloo, Black Hawk County, Iowa, described as follows : Commencing at a point on the West line of said Northeast Quarter (NE 1/4 ) which is Thirty-three ( 33 ) feet South of the Northwest corner of said Northeast Quarter (NE 1/4 ) ; thence East Sixteen and Five Tenths ( 16 . 5 ) feet to the point of intersection of the South line of Independence Avenue and the East line of Idaho Street as established in Deed Record 444 at page 467 , Black Hawk County Recorder ' s Office and the point of beginning; thence Southeasterly Three Hundred Twenty-eight and Five Tenths ( 328 . 5 ) feet along said East line of Idaho Street as described in Record 444 at page 467 to the Easterly extension of the North line of Block Six ( 6 ) , Hillside Addition; thence East Twenty-five ( 25 . 0 ) feet along said Easterly extension; thence Northwesterly Three Hundred Twenty-eight and Five Tenths ( 328 . 5 ) feet to a point on the South line of Independence Avenue which is Twenty-five ( 25 ) feet East of the point of beginning; thence West Twenty-five ( 25 ) feet to the point of beginning.
