RESOLUTION INSTRUCTING THE BLACK HAWK COUNTY
COMMISSIONER OF ELECTIONS TO CONDUCT A SPECIAL ELECTION
FOR THE PURPOSES OF GRANTING A TWENTY ( 20) YEAR
FRANCHISE TO IOWA PUBLIC SERVICE COMPANY FOR GAS AND
ELECTRIC SERVICES, IN THE CITY OF WATERLOO, BLACK HAWK
COUNTY, IOWA.
WHEREAS, Ordinance No. 3552 granting to Iowa Public Service
Company, its successors and assigns , authority to erect, maintain
and operate plants and systems for electric light, heat, and power
and electric distribution systems in the City of Waterloo, Iowa,
(herein "The City" ) for a period of twenty ( 20 ) years and to
furnish electrical energy to said City and its inhabitants for
light, heat and power purposes, and including the right to
construct high voltage electric transmission lines into and
through the said City, providing for the regulations and
conditions under which the said right is to be exercised and to
provide for the prevention of damage to property, and to provide
for notice of damages power lines, and to confer the power of
condemnation thereof has been duly passed by the City Council of
Waterloo on May 2 , 1988 , and approved by the Mayor thereof; and
WHEREAS, Ordinance No. 3551 granting to Iowa Public Service
Company, its successors and assigns, the right, franchise and
authority to erect, maintain and operate gas plants, transmission,
and distribution systems and to furnish gas service for public and
private use within the City of Waterloo, Iowa, (herein "The City" )
for a term of twenty ( 20) years, and to establish the conditions
required and manner of use of streets and public grounds of the
City in which said gas works may be located, and to provide for
notice of damaged pipelines , and to confer the power of
condemnation of private property thereof has been duly passed by
the City Council of Waterloo on May 2 , 1988 , and approved by the
Mayor thereof; and
WHEREAS, said ordinances provide that they shall not become
effective or binding until they shall have been submitted to and
approved by a majority of the electors of said City of Waterloc
voting at a special election called for that purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WATERLOO, IOWA:
Section 1 . That the Waterloo City Council instruct the Black
Hawk County Commissioner of Elections to conduct a special
election ordered to be held in said City of Waterloo, Iowa, on the
28th day of June, 1988 , from 7: 00 o' clock A.M. , C.D.T. , ( 6 : 00
o' clock A.M. , C.S.T. ) to 8: 00 o ' clock P.M. , C.D.T. ( 7 : 00 o 'clock
P.M. , C.S.T. ) for the purpose of submitting to the qualified
voters of said city, to be by them voted upon, the propositions of
granting the said franchises to the Iowa Public Service Company,
its successors and assigns.
Section 2 . That the question will be prescribed in the
following summary form:
SHALL ORDINANCE NO. 3552 (Electric Franchise) BE ADOPTED?
"Shall Iowa Public Service Company be granted a twenty ( 20 )
year electric franchise in the City of Waterloo, Iowa?"

"Shall Iowa Public Service Company be granted a twenty ( 20)
year gas franchise in the City of Waterloo, Iowa?"

o Section 3 . That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed.
Section 4 . That this resolution be in force and effect
immediately upon its passage and approval.
