o E H RESOLUTION APPROVING A SETTLEMENT AGREEMENT WITH WARREN
(� :y TRANSPORT, INC. ( IN SETTLEMENT OF WARREN TRANSPORT,
r,., � ��� INC. , ET AL VS. CITY OF WATERLOO, ET AL, CASE NO. 69688 )
AND DIRECTING EXECUTION OF SAID AGREEMENT BY THE MAYOR.

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
That the Settlement Agreement by and between Warren
Transport, Inc. and the City of Waterloo, Iowa, ( in settlement of
Warren Transport, Inc. , et al v. City of Waterloo, et al, Case No.
69688 ) , committing the City of Waterloo as follows:

H!H "Part 1: City of Waterloo' s Commitment
Offer and make available to Warren Transport, Inc. upon
terms as advantageous as permitted by law any and all
,n tax abatement programs;

( B V, Support Warren Transport, Inc. ' s application for
sIn N C.E.B.A. and R. I .S.E. loans for grants, including
E,1 co assistance in completion of any applications therefore,
h > the preparation and submission of any reports or studies
s E, that may be required at City of Waterloo' s expense and

^i the appearance before any governing body at such
location in the State of Iowa as may be required to
promote or support such application;

New jobs credit through Hawkeye Institute of Technology
under Section 623 ; and then secure, pursue, and make
available under other jobs credit or training programs,
as permitted by law;
D. Unqualified support for Warren Transport application for
W. I .D.A. assistance grants, including but not limited
to, assistance in completion of any applications
therefore, the preparation and submission of any reports
or studies that may be required at City of Waterloo' s
expense and the appearance before such body as may be
required to promote or support such application;
E. That the City shall resolve any traffic congestion
problems that may arise from the location and operation
of the IBP plant at the chosen site, without expense or
tax assessment to Warren Transport, Inc. ; and, the City
shall adopt an appropriate resolution of the Council to
effectuate this provision;
F. Warren Transport, Inc. may designate the person to fill
the position of honor with respect to any IBP, inc.
announcement;
G. In the event the City fails to honor the commitments
contained herein, the City shall reimburse Warren
Transport, Inc. for all expenses incurred in resolving
the above issues; "
said Settlement Agreement be and the same is hereby approved, and
the Mayor authorized to execute the same on behalf of the City of
Waterloo, Iowa.
PASSED AND ADOPTED this 23rd day of May, 1988 .
