RESOLUTION NO. 1988-264

RESOLUTION AUTHORIZING THE CONDEMNATION OF A PARCEL OF
REAL PROPERTY FOR. THE FY 1988 VINCENT AND LONGVIEW
CULVERT REPLACEMENTS, CONTRACT NO. 326 .
WHEREAS, the City of Waterloo, Iowa, has undertaken the FY
1988 Vincent and Longview Culvert Replacements , Contract No. 326,
and the parcel of land hereinafter described have been appraised
and an offer made to the owner of said property in the amount of
the appraised value and said offer has been refused and funds are
available with which to pay for the said parcel from City funds;
and
WHEREAS, the acquisition, by Temporary Easement, Permanent
Easement, or Fee Simple Title of the hereinafter described real
property is necessary in connection with the said FY 1988 Vincent
and Longview Culvert Replacements, Contract No. 326 .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the following described parcel of
real property be acquired by condemnation in the manner provided
by law, and such other further action as may be necessary to
effect acquisition:
Parcel No. 5--Claude and Miriam Brown, Owners
Midway Castle Hill West Ten ( 10 ) feet, North Forty ( 40 ) feet,
Lot 6, all in the City of Waterloo, Black Hawk County, Iowa.
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WATERLOO, IOWA, that if the owner of said property and
the City of Waterloo, Iowa, agree to a settlement prior to the
time and date for commencement of condemnation proceedings, such
further action relating to the condemnation shall be null and void
and the Mayor and Clerk/Auditor be authorized and directed to
execute all instruments necessary to consummate the agreement to
purchase the property from the owner thereof, and the deed for the
conveyance of the same are also accepted and approved and the City
of Waterloo is directed to pay for the property and the incidental
expenses necessary to the consummation of the sale from City
funds.
PASSED AND ADOPTED this 23rd day of May, 1988 .
