RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION,
PERMANENT AND TEMPORARY EASEMENT CONTRACTS TO SELL REAL
PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN
DEEDS AND EASEMENTS.
WHEREAS, the City of Waterloo, Iowa, has had all the parcels
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcels
is necessary to carry out the FY 1988 Northeast Area Sanitary
Sewer Extension, Contract No. 344 ,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcels
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which are situated in the City of Waterloo, Black
Hawk County, Iowa, are accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreement to purchase the properties from the
owners thereof, and the deeds for the conveyance of the same are
also accepted and approved and the City of Waterloo is directed to
pay for the properties and the incidental expenses necessary to
the consummation of the sales from City funds.
The subject parcels are:
IBP, inc. , Owner--Temporary Easement
All that part of the East 1/2 , of the Northeast 1/4 of
Section 21 , Township 89 North, Range 12 West of the Fifth
Principal Meridian, Black Hawk County, Iowa, lying south of
the Chicago and North Western Transportation Company Railroad
right-of-way described as follows:
A strip of land 30 feet in even width, the northerly line of
which is 30 feet south of and parallel with the southerly
right-of-way line of said railroad.
Excepting therefrom that part thereof contained in the
presently established right-of-way of Elk Run Run.
IBP, inc. , Owner--Permanent Easement
All that part of the East 1/2 , of the Northeast 1/4 of
Section 21 , Township 89 North, Range 12 West of the Fifth
Principal Meridian, Black Hawk County, Iowa, lying south of
the Chicago and North Western Transportation Company railroad
right-of-way described as follows:
A strip of land 30 feet in even width contiguous to, south of
and parallel with the southerly right-of-way line of said
railroad.
Excepting therefrom that part thereof contained in the
presently established right-of-way of Elk Run Road.

All that part of the West 1/2 of the Northeast 1/4 of Section
21, Township 89 North, Range 12 West of the Fifth Principal
Meridian, Black Hawk County, Iowa, and the East 380 . 0 feet of
the Northwest 1/4 of said Section 21 , lying south of the
Chicago and North Western Transportation Company railroad
right-of-way described as follows:
A strip of land 30 feet in even width, the northerly line of
which is 30 feet south of and parallel with the southerly
right-of-way line of said railroad.

RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION,
