HomeMy WebLinkAbout1988-334-06.20.1988 RESOLUTION NO. 1988-334 RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION, PERMANENT AND TEMPORARY EASEMENT CONTRACTS TO SELL REAL PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN DEEDS AND EASEMENTS. WHEREAS, the City of Waterloo, Iowa, has had all the parcels described herein appraised and the fair market value ascertained, and WHEREAS, the acquisition of the hereinafter described parcels is necessary to carry out the FY 1988 Northeast Area Sanitary Sewer Extension, Contract No. 344 , NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the contract for the parcels hereinafter described to sell the same to the City of Waterloo, Iowa, all of which are situated in the City of Waterloo, Black Hawk County, Iowa, are accepted and approved and the Mayor and City Clerk are authorized and directed to execute the same in behalf of the City and to execute all instruments necessary to consummate the agreement to purchase the properties from the owners thereof, and the deeds for the conveyance of the same are also accepted and approved and the City of Waterloo is directed to pay for the properties and the incidental expenses necessary to the consummation of the sales from City funds. The subject parcels are: Wayne and Aniceta Claassen, Owners--Permanent Easement Two parcels of land located in the Northwest 1/4 of the Northwest 1/4 of Section 22, Township 89 North, Range 12 West of the Fifth Principal Meridian, Black Hawk County, Iowa, described as follows: Beginning at the point of intersection of the South right-of-way line of Newell Street (R-O-W line being 33 feet South from and parallel with the North line of the Northwest 1/4 of said Section 22) with the Northwesterly right-of-way line of the Chicago and North Western Transportation Company Railroad (R-O-W line being 50 feet Northwesterly from and parallel with the center line of the main railroad tracks) ; thence Southwesterly along said Northwesterly railroad right-of-way line a distance of 694 . 35 feet; thence Northwesterly normal to said railroad R-O-W line a distance of 30 feet; thence Northeasterly parallel with said railroad R-O-W line a distance of 612. 46 feet to the South R-O-W line of Newell Street; thence East a distance of 87. 21 feet to the point of beginning; and, Beginning at the point of intersection of the West right-of-way line of Elk Run Road (R-O-W line being 60 feet East from and parallel with the West line of the Northwest 1/4 of said Section 22) with the Southeasterly right-of-way line of the Chicago and North Western Transportation Company Railroad (R-O-W line being 50 feet Southeasterly from and parallel with the center line of the main railroad tracks) ; thence Northeasterly along said Southeasterly railroad right-of-way line a distance of 169 . 38 feet; thence Southeasterly normal to said railroad right-of-way line a distance 30 feet; thence Southwesterly parallel with said railroad R-O-W line a distance of 180 . 22 feet to the East R-O-W line of Elk Run Road; thence North a distance of 31 .89 feet to the point of beginning. :,. 8 Resolution No. 1988-334 Page 2 Wayne and Aniceta Claassen, Owners--Temporary Easement Two parcels of land located in the Northwest 1/4 of the Northwest 1/4 of Section 22 , Township 89 North, Range 12 West of the Fifth Principal Meridian, Black Hawk County, Iowa, described as follows: Beginning at a point on the South right-of-way line of Newell Street (R-O-W line being 33 feet south of and parallel with the North line of the Northwest 1/4 of said Section 22) which point is 87 . 21 feet West of the point of intersection of the South right-of-way line of Newell Street with the Northwesterly right-of-way line of the Chicago and North Western Transportation Company Railroad (R-O-W line being 50 feet Northwesterly from and parallel with the center line of the main railroad tracks) ; thence Southwesterly along a line which is 30 feet Northwesterly from and parallel with said Northwesterly Railroad R-O-W line a distance of 612 . 46 feet; thence Southeasterly normal to said railroad R-O-W line a distance of 30 feet; thence Southwesterly along said Northwesterly railroad R-O-W line a distance of 30 feet; thence Northwesterly normal to said railroad R-O-W line a distance of 60 feet; thence Northeasterly parallel with said railroad R-O-W a distance of 560 . 56 feet to the South R-O-W line of Newell Street; thence East a distance of 87 . 21 feet to the point of beginning; and, Beginning at a point on the West right-of-way line of Elk Run Road (R-O-W line being 60 feet East from and parallel with the West line of the Northwest 1/4 of said Section 22 ) which point is 31. 89 feet South of the point of intersection of the East right-of-way line of Elk Run Road with the Southeasterly right-of-way line of the Chicago and North Western Transportation Company railroad (R-O-W line being 50 feet Southeasterly from and parallel with the center line of the main railroad tracks) ; thence Northeasterly along a line which is 30 feet Southeasterly from and parallel with said Southeasterly railroad R-O-W line a distance of 180 . 22 feet; thence Northwesterly normal to said railroad R-O-W line a distance of 30 feet; thence Northeasterly along said Southwesterly railroad right-of-way line a distance of 30 feet; thence Southeasterly normal to said railroad R-O-W line a distance of 60 feet; thence Southwesterly parallel with said railroad R-O-W a distance of 221. 03 feet to the East right-of-way line of Elk Run Road; thence North a distance of 31 . 89 feet to the point of beginning. Excepting therefrom that part thereof contained in the right-of-way of Newell Street and the Leather Processor Access Road. The bearing of the center line is based on the assumption the South line of the Southwest 1/4 of said Section 15 bears North 89°22 ' 40" East.
