RESOLUTION ACCEPTING AND APPROVING CERTAIN ACQUISITION,
PERMANENT AND TEMPORARY EASEMENT CONTRACTS TO SELL REAL
PROPERTY TO THE CITY AND ACCEPTING AND APPROVING CERTAIN
DEEDS AND EASEMENTS.
WHEREAS, the City of Waterloo, Iowa, has had all the parcels
described herein appraised and the fair market value ascertained,
and
WHEREAS, the acquisition of the hereinafter described parcels
is necessary to carry out the FY 1988 Leather Processor Access
Road, Contract No. 343 ,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the contract for the parcels
hereinafter described to sell the same to the City of Waterloo,
Iowa, all of which are situated in the City of Waterloo, Black
Hawk County, Iowa, are accepted and approved and the Mayor and
City Clerk are authorized and directed to execute the same in
behalf of the City and to execute all instruments necessary to
consummate the agreement to purchase the properties from the
owners thereof, and the deeds for the conveyance of the same are
also accepted and approved and the City of Waterloo is directed to
pay for the properties and the incidental expenses necessary to
the consummation of the sales from City funds.
The subject parcels are:
Wayne and Aniceta D. Claassen, Owners--Temporary Easement
Two parallels of land in the Southwest 1/4 of the Southwest
1/4 of Section 15 , Township 89 North, Range 12 West of the
Fifth Principal Meridian, Black Hawk County, Iowa, described
as follows:
Commencing at a point on the east line of the Southwest 1/4
of the Southwest 1/4 of said Section 15 , which point is
807. 81 feet north of the Southeast corner of the Southwest
1/4 of the Southwest 1/4 of said Section 15; thence South
80°09 ' 52" West a distance of 124 . 36 feet to the point of
beginning of the parcel herein described; thence continuing
South 80°09 ' 52" West a distance of 151 . 96 feet; thence South
00°37 ' 20" East a distance of 50. 00 feet; thence North
89°22 ' 40" East a distance of 150. 00 feet; thence North
00°37 ' 20" West a distance of 74 . 33 feet to the point of
beginning.
and also,
Commencing at a point on the East line of the Southwest 1/4
of the Southwest 1/4 of said Section 15 , which point is
873 . 81 feet North of the Southeast corner of the Southwest
1/4 of the Southwest 1/4 of said Section 15; thence South
89°22 ' 40" West a distance of 26 . 24 feet; thence North
79°10 ' 33" West a distance of 153 . 04 feet to the point of
beginning of the parcel herein described; thence South
89°22/40" west a distance of 150. 00 feet; thence North
00°37 ' 20" West a distance of 60. 00 feet; thence North
89°22 ' 40" East a distance of 150 . 00 feet; thence South
00°37 ' 20" East a distance of 60 . 00 feet to the point of
beginning.
Bearings are based on the assumption the South line of the
Southwest 1/4 of said Section 14 bears North 89°22 ' 40" East.
